(Expires 3/19/2024) The applicant was present. The manager, Jessie Fonseca said that the call was not true regarding the item on the police report. Individuals in opposition: Bryana K. - 2255 S Allis St. – she said that she is concerned about the noise that they experience at the common areas and individual units at the condominium. She added that she would like to see the committee to take the neighbors in consideration when granting this type of licenses. Gregg – 2255 S Allis St. – said that Jessie has good communication with the condo neighbors but that they consider this area more residential rather than commercial and that they want the committee to take in consideration the neighbors who live there before this business opened. Samantha – 2255 S Allis St – said that the main concern is that the building is old, that the sound has been kind of controlled but that the floors and walls shakes no matter what. She added that there must be a study prior granting licenses because she is not sure that the building can take such vibrations. Nick Pond – 2255 S Allis St – said that his unit is directly above from the dance floor and that the vibrations on top of the noise (68 decibels) makes it very difficult to sleep. He added that the building supposed to be a mixed use but that the building is not accommodating the residential part of it. He also said that Ald. Dimitrijevic seems trying to discourage them from taking actions but that things like soundproofing must be done. Ald. Coggs said that this committee appreciates any comments from the neighbors and that they will not be discourage from taking action. Ald. Dimitrijevic said that she has been in many conversations with neighbors and that herself has asked the neighbors to call the police if they feel that the sound is too loud. She also said that there has been a discussion with the applicant to close earlier during the week. Ald. Coggs asked the applicant if he is willing to amend the hours of operation to close at 10pm, Sun – Thu. The applicant agreed. Ald. Brostoff moved to amend the hours of operation to close at 10pm from Sun to Thu. There were no objections. Individuals in support: Nick Lawrence – resident of Wauwatosa – said that he owns the location where this business stands and that the building was not designed with sound proof in mind. He added that the applicant has been very responsive, that he got an advice from a sound engineer who said that they would need to deconstruct the building if they want to sound proof it. He added that there are three different parties who could be responsible for soundproofing. Ald. Brostoff said that he should be responsible for this because he is the one making money out of the premises and asked why the condo owners should be responsible for the noise coming out of his premises. Ald. Borkowski asked when Sabor Tropical came into the building or when the business model changed. Gregg said that the change happened on 2023. Ald. Coggs said that looking at the record something change on 2023 with the license, which also affected the neighbors according to the neighbors’ testimony and our records. She asked the applicant to look back and discuss it with the neighbors to make a compromise as Ald. Borkowski asked for. Ald. Dimitrijevic asked the License Division for the previous hours of operations. Mr. Cooney said that the previous entity closed at 10pm Sun – Wed and at 12AM Thu – Sat. He added that in November of 2020 the hours were amended to close at 2AM on Thu and 2:30AM Fri & Sat. He also said that new entity applied to close at 2AM on the weekends. Ald. Dimitrijevic said for the record, there were neighborhood meetings for those hours of operation. She added that KK is a commercial corridor, that there are other business running along with the same hours and that she is looking for some balance. She also said that this past weekend was the quietest weekend for this business in the area and that Mr. Gregg acknowledged it as well. She added that there must be a discussion on the next months with the premises owner (Mr. Lawrence) and that it is the only way to move forward. She added that she recommends renewal with a warning letter to have a record to validate the neighbors’ concerns and the she will be monitoring this issue closely. She also asked the applicant to amend the application to close at 10PM Sun-Thu. Mr. Fonseca said that he is committed to make things work for his business and neighbors and that he will meet with Mr. Lawrence to discuss soundproof issues. Ms. Lopez suggested Mr. Fonseca to apply for the Class B Manager’s license as well. Ald. Chambers moved approval as amended with a warning letter and to hold the issuance until the delinquent bill is taken care of. There were no objections. (Prevailed 5-0)

She also said that she objects to the late hours everyday because the neighborhood will be impacted negatively. She added that this applicant filed an application for a nightclub. Mr. Greenmeier – 4111 S Burrell St – said that he agrees with the neighbors and that the parking and late hours are a problem for him. Ald. Spiker said that a neighborhood was held last week at the establishment, that 5 neighbors showed up in opposition. He also said that before this application made its way to the neighbors; he talked to applicant about the neighbors’ concerns in the past about public entertainment. He also said that he was provided with a new menu for cold food at the meeting, that the place is bigger with no kitchen and that he cannot support this application for these reasons, parking and because this is a residential area. The applicant said that they can use half of the next door parking lot that belongs to We Energies, that they have a variety of cold dishes and that they are pursuing to operate as a restaurant bar from open to close. Obviagele said that the matters on the police report have been read and heard by the committee before and that the criminal matter still pending at the court. He also said that the committee recommended a 45 day suspension for this application, then was sent back to committee and then it was held. He added that they have been discussing the circumstances and that they do not believe that there is any further basis to have this matter held. He said that they are proposing to bring this business back to business while the charges still pending and that the committee could use its powers to bring the applicant back after the verdict. Atty. Obviagele said that underlying allegations resulted in a search warrant that led to uncovering some weapons and marijuana. He added that the marijuana was not found in the premises if there. He added that the marijuana was found in a vehicle outside of the premises and the guns were found upstairs, on the residential area of the premises and not on the licenses and asked that the license be renewed. Individuals also present: Ald. Brostoff said that the last time that they appeared there were some allegations about the business being targeted or an ulterior motive behind the search warrant. Atty. Richmond said that she was questioning the timing of the filing of the criminal charges in relationship with the license renewal. Ald. Brostoff asked Atty. Richmond if she has some information about that. Atty. Richmond said that she does not have any information but that she hopes that it will be provided once they close all of the discovery. Ald. Borkowski said that we have some representation from the police department, 6th district, that they have taken the time to testify and that it is important for the committee to hear the severity of this application. Ald. Spiker provided a timeline of what have happened with this application: -On Nov. 28 he recommended a 90 day suspension, the committee made a 45 day suspension recommendation to the Common Council and then it was sent back to committee. In the meantime Mr. Flores was charged with possession of firearms. -At the next hearing in January, the application was held because of some developments in the case. -Brought forward again. He added that he checked the record and Mr. Flores himself said that he had some issues with management and that is why he closed his shop in Green Bay and moved back to Milwaukee, got rid of the manager, that the weapons were found on what he referred to as “break room”. He also said that six weapons were recovered and a silencer and that Mr. Flores on his own words said that the weapons were not his, that people had concealed carry permits for. Ald. Spiker said that he and the committee members were alarmed about the weapons on the premises and what led to this. He said that according to Mr. Flores’ testimony, there was some sort of lack of oversight and that it was the basis under which he recommended the 90 day suspension. He added that if there were no questions about mismanagement, the 90 day suspension would have expired today. He also explained that 90 days for lack of oversight might be acceptable but if Mr. Flores is complicit in the stashing of the weapons when he is a felon; that would move him to recommend nonrenewal. He added that he agrees with Ald. Borkowski on hearing the police officers testimony. Ald. Coggs asked the applicant is the business has been open in some way. Mr. Flores said that the business has been closed for 120 days. Ald. Chambers asked Atty. Farris if hearing the police officers testimony will harm, the criminal case. Atty. Farris said that the full testimony might be given out at trial and that they can testify about matters that were revealed at the preliminary hearing (which is one of the things that were waiting for) and the cause to bind Mr. Flores over for a trial. Atty. Obviagele said that most of the judges stay when there is a criminal case that is tied to a civil case because there is a fundamental understanding based on the Fifth Amendment that any prosecution or defense in the civil case will be quite right limited, especially if it involves a person who’s been accused of a crime. He also said that this is the reason why they are willing to stipulate to come back to committee after the case is done and that he hopes that the committee would consider that. Atty. Farris said that Mr. Flores would be in a disadvantage because he would not be able to give his full explanation here today (Fifth Amendment Right) however, the ordinance does not require a conviction for suspension or nonrenewal. Atty. Farris read 85-4-4- GROUNDS FOR NONRENEWAL, SUSPENSION OR REVOCATION. The recommendations of the committee regarding the applicant shall be based on the preponderance of evidence presented at the hearing. Unless otherwise specified in the code, probative evidence concerning non-renewal, suspension or revocation may include evidence of: b. Pending charges against or the conviction of any felony, misdemeanor, municipal offense or other offense, the circumstances of which substantially relate to the circumstances of the particular licensed or permitted activity, by the applicant or by any employee or other agent of the applicant. Atty. Farris said that we are not here to find him guilty but that it is up to the committee to conclude if Mr. Flores was or was not responsible for what happened. The committee agreed to hear the police officers’ testimony. Captain Pfeiffer – District 6 – said that the officers directly involved in the search warrant held back in April are here. He added that as a result of that investigation, they were looking at the possibility to file charges on the federal side instead of the state side, and that it was later determined that state charges seemed more appropriate at the time and that is the reason why it took so long to file the charges. He also said that the preliminary hearing was held on Jan 10th, that a probable cause was found. He also said that they will be cautious about the answers but that they are here to provide whatever answers they can. Ald. Brostoff asked what the motivation for the search warrant was. Captain Pfeiffer said that they received information that the business was involved in narcotics traffic and that they had firearms. He added that the Violent Crimes Reduction Team investigated these claims and found enough evidence to go forth with the search warrant to obtain more evidence. Atty. Richmond asked Captain Pfeiffer if there was another individual being the target of this warrant. Captain Pfeiffer said that they were not aware of any specific targeted person, they just look at the business itself. Atty. Richmond said that Mr. Webb was articulated in the affidavit that was accompanied the search. Captain Pfeiffer said that it is correct. Atty. Richmond asked if Mr. Webb was the one in possession of the marijuana. Captain Pfeiffer said that Mr. Webb was in possession of the marijuana found in his vehicle. Atty. Richmond asked if other marijuana was found there. Captain Pfeiffer said that the officers can testify about it. Atty. Obviagele asked Captain Pfeiffer if he can provide the names of who was involved in the discussion to decide how to file charges and who provided the information that led to the investigation. Captain Pfeiffer answered that he cannot provide any names to both questions. Ald. Spiker asked where was the car where the THC was found. Captain Pfeiffer said that the vehicle was adjacent to the establishment. Officer Robert Lawrence Jr – said that he was one of the lead investigators in this particular case, that they received information about the business being in possession of firearms and narcotics that were above the amount of personal use. Atty. Obviagele said that he objects to the extent that Officer Lawrence is going to testifies about the information received. Officer Lawrence said that they executed a search warrant and explained that the premises have two levels, the lower level is set up as tattoo parlor and that the upper level is split in two halves. One half is set up as a living premises (with kitchen, bedroom for an adult, bedrooms for children with washer and dryer); and that the other half is also set up as a tattoo parlor with two chairs, tattoo equipment and tattoo artists licenses posted on the wall. He added that they found the weapons on both halves of the upper level. Ald. Coggs asked Mr. Cooney to check the licensed premises description. Atty. Farris asked if the weapons were in plain view. Officer Lawrence said that the weapons were found in the upper level, some on the tattoo shop, some on the residential half, some weapons were concealed and some weapons were in plain view. Ald. Coggs asked if the applicant’s fingerprints were found on any of the weapons. Officer Lawrence said that he needs to review the laboratory reports. Atty. Obviagele asked Officer Lawrence if it is fair to say that there are DNA records and that he needs to review the reports. Officer Lawrence said that it is fair observation. Atty. Obviagele asked Officer Lawrence if it is correct that the weapons subjected to the criminal compliant were found in the residential premises area of the building. Officer Lawrence said that the criminal complaint is correct and that as he testified to his observation, that the weapons were found on both halves of the upper level. He added that he personally recovered firearms on both, the tattoo shop and the residential unit. Atty. Obviagele said that Officer Lawrence impressions whether or not there was a tattoo shop upstairs is only his opinion. Mr. Cooney said that the Health Department confirmed that the half of the upper level is used as part of the tattoo operations. Officer Nathan Grap – said that one of the main reasons why they got the search warrant was because they reviewed body camera footage and that is how they were able to establish that Mr. Flores resides in the premises. Atty. Obviagele objected to this testimony on the basis of reviewing body cam footage/hearsay. Ald. Coggs said that Atty. Obviagele asked for names of who made the claims and who participated in the decision to file charges at the beginning. Officer Grap – said it was not only the body cam footage but also a burglary police report filed with the premises address on Thanksgiving 2022 and that the applicant identified himself as the resident and walked the police through. Atty. Obviagele objected to this testimony on the basis of hearsay. Ald. Coggs asked the applicant if they suffered a robbery on Thanksgiving 2022. The applicant answered “yes”. Ald. Coggs asked the applicant if he let the police in. The applicant answered “yes”. Ald. Spiker said that his concern is that the applicant knew that the weapons were there and that what we have heard today is different from what the applicant has testified before. Ald. Chambers said that there is more than what it has been presented today and that for him, nothing justify the fact that the applicant let the license lapse for almost 4 months before filing the renewal application. Ald. Coggs said that when the applicant first came before committee, there was very little information on the police report and from the applicant and his attorney. She added that when they came back, the information was a little contradictory and now is even more after hearing the police officers. She said that she does not how the applicant could have managed the business and the building in a responsible way. She added that regardless of the parts that we do not want to hear, the committee do not feel comfortable with the way he managed the business and the building before, and that all what have happened were choices the applicant made. Atty. Obviagele said that he understands the concerns and that is why he wants the applicant to testify later when he is able to speak freely and not in disadvantage. He added that his client already went beyond the 90 days suspension recommended before. He asked for the license to be renewed and that they will come back after the trial. Atty. Richmond said that the applicant has a circuit court hearing in nine days. Atty. Farris suggested that if the committee wants to hold open the item on the police report then a motion for discipline should not be based on the pending charges. Ald. She added that the applicant was rude and verbally violent when she approached and took photos that were added to the file. Atty. Chambers asked if the contact with the management company happened after receiving the notice. Atty. Toran said it happened after receiving the notice. Ms. Hegarty said that they decided to put an objection to this applicant because he has been operating ignoring orders like working without a base, running water, without a license, etc. She added that the last altercation involved stabbing in front of the health inspector and that it is a matter of safety for the public. Individuals in support: Dominique Smith - 3239 N 38th St – said that the applicant keeps young people out of the street and that it is very infuriating for him to see the applicant challenged this way when he is trying to build something from the ground up. Tony Haberson – said that he works in the food/bar industry and that he understands the challenges that the applicant faces and that he has only good things to say about him. He added that we all make mistakes at some point but that he has hired an attorney and has secured a permanent base. Tanishia Grant – said that she has been a customer over three years and that she has not seen any of the frustrations that were talked over here and that he should have been given a chance. Ms. McHenry said that she is a person of faith and that she is willing to withdraw her objection and that the applicant must treat people with respect. Individuals also present: Ald. Rainey said that he has heard about individuals asking for a chance to redeem themselves and that he is grateful for Ms. McHenry’s willingness to give the applicant a second chance and that he supports the application. Ald. Chambers asked the applicant to treat every person with respect and dignity and that he also supports second chances. Ald. Brostoff said that whatever happened to him in the past is not an excuse to treat people as he has and he wants to make sure that he understands that he must treat people with respect. Ald.
