Borkowski said that this is unfair to the applicant and that he does not understand why are we investing in district improvements if we are not trusting its recommendations. He added that it is a long shot for the applicant to wait six months until the chair is filled and that it is not the applicant's fault and moved for approval. The applicant said that she and her partner will be running the place and that it won’t be a night club at all. Ald. Spiker asked if we can hear from the City’s attorney office about if we are whether able to take written letters rather than people’s testimonies. Ald. Coggs said that she wants to request a formal opinion on this matter (written petitions vs oral testimonies). Atty. Farris said that for new licenses is up to the committee’s discretion. Ald. Spiker moved to hold the application until Mr. Hamilton (former alderman) is available for this meeting. Ald. Borkowski moved to reconsider the application at 9:45 am. There were no objections. Mr. Hamilton was present who said that he believed that this application has the support of the business improvement district and that there is a project to revitalize and enhance the area. Ald. Perez asked is this is a new application. Mr. Hamilton said that it is a new application with the same use as before. Ald. Spiker asked if there were any issues in the past. Mr. Hamilton said that there are no issues in the past with this location and that this building was sold after the pandemic. Ald. He added that they have set up the surveillance cameras and even in the direction that the neighbors wanted them, and that he will reach out to Ms. Anderson. Mr. Cooney confirmed that on the recent inspection, there 3 amusement machines were there still but that could not be played because of the lack of the deposit case. Ald. Perez said that it is disturbing the fact that there are no records of service calls but that there are neighbors present to testify. He added that there will be a ban for food trucks which is part of the problem as well. He added that calls for service are needed. The applicant said that there is a parking lot behind the gas station that the owner has put up a fence to avoid people coming in and out and that he has put cameras behind as well and asked Ms. Zino at what time of the day she sees that type of activities. Ms. Zino said that during the school hours from 8am and 4pm and that the activities happen on the side by the dumpster. Ms. Patricia Najera - 2110 W National Av – said that she is in opposition because she is in the neighborhood on a daily basis and that she knows the nuisance that this building represents and that it impacts the living and health of the neighbors. She added that the extended hours are not needed. Ald. Perez asked what she sees when she is around. Ms. Najera said that prostitution, drug dealing, loitering and garbage. Sam Cunningham – Business Consultant for Pete’s Fruit Market – said that they want to do a great business area in the city and that to do that they must partner with neighbors, leaders, etc and that the customers of this location disturb the entire community and asked to hold the application to encourage a talk with business owners and neighbors. He added that he is concerned about the extended hours as well. Ald. Perez asked if he has witnessed any of the things discussed today. Mr. Cunningham – said that he has not since he does not live in the area. Ald. Spiker asked if they can continue taking the testimony if the extended hours license is not part of today's hearing Ald. Perez said that the extended hours license goes moot if the other licenses are not renewed. Atty. Farris, Ald. Coggs and Mr. Cooney agreed. Brisa Van Galin – 2110 W National Av – said that it is very hard to bring investment in the community because of these types of behavior are allowed at the gas station. Alison Henderson – 807 S 14th St – said that she works every day in the neighborhood and that youth and women are harassed and solicited while pumping gas or at the premises and that she has seen it herself. Travis – said that he goes to the store about ten times a week and he sees the same thing over and over: drug dealing, drug use, needless everywhere, people sleeping in there, etc. He added that this property has been a nuisance before and that it continues being a nuisance and that it will be the same way because this gas station allows these behaviors. Araceli Arevalo – resident and customer – said that she stopped going there because she has experienced the drug dealing, open sex and harassment. She added that she got a chance to meet applicant back in 2020 when he took care of the garage that was behind the property and that the issues have increased since then. She added that other businesses like Pete’s do not have these issues and that she has seen people coming out from the back of the building and not pumping gas or buying items at the store and that nothing has been done all this time. Lieutenant Sheehan on behalf of district 2 – said that he won’t repeat the issues but that they have received calls for altercations, over doses and lastly the open drug dealing resulting in a officer involved shooting. Ald. Perez asked why these issues do not evolve to PA-33. Lieutenant Sheehan said that it is up to the police’s discretion. Individuals also present: Ald. Perez said that neighbors have stepped up and that he has seen it and documented it as well. Maistelman who said that at the last meeting, someone asked if his client was cooperative with the police when the call for over dose happened which he was. He added that his client lives on the premises, and that they have had a very productive meeting with the police and that they are making progress. Ald. Spiker asked about training people on how to identify people who check-in for drug use. Vi Shah – owner's son -said they have had an informative meeting with the police and that they have received some tips on how to keep secure the building and on how to identify suspicious activities among other issues. He added that they worked through different scenarios to identify possible issues. Ald. Spiker asked if there is anything more systematic in place rather than tips from the police. Atty. Maistelman said that there is no staff per se but that this business is run by the family and that the over dose problem is growing. Ald. Spiker said that it is an epidemic but that it seems that this hotel seems to have this issue more than others. Individuals in opposition: Lydia Hernandez – said that to clean up the premises and to have surveillance cameras is not enough. She added that training is needed and that this hotel is a nuisance and that it does not do anything for the community, and that they don’t deserve the license because it does not bring anything good to the community. Atty. Maistelman asked Ms. Hernandez if she asked the hotel to set up a memorial. Ms. Hernandez said that she and her sister wanted to protest in front of the hotel and that they were attacked on the parking lot by the family that own the business, and that she called the police to explain the situation and her right to protest on the sidewalk. She added that the memorial was left as the result of that altercation and that she did not receive a permission to do so. Atty. Maistelman asked Mr. Shah what happened when the mother appeared at the hotel after the passing. Ms. Shah said that one of his family members asked the ladies what was going on and that the mother requested to set up a memorial. He added that she was told that a memorial was a fire hazard for the property but that she could do it at the sidewalk instead. He added that his family was attacked by Ms. Hernandez as well with remarks about the poor English they spoke. Individuals also present: Ald. Dodd asked if the applicant have made the commitment to include the training. Mr. Shah and Atty. Maistelman said that they agree to do a proper training. Ald. Individuals in opposition: Sandra Zappaterreno – 1326 and 1328 N Astor St – Building owner for over 50 years – asked why she did not receive the notice if she owns the building. Mr. Cooney said that it is by ordinance that notices are mailed out to current occupants of a 250.0 feet radius. Ms. Zappaterreno said that she has photos of two vans where people sleep, with their feet hanging out from the windows, and that they even defecate at her lawn and then they go to St. Catherine’s. She said that she have reported it to the police and that she understands that there is a stretch but, that she pays a lot of taxes for her properties and wants to have nice tenants but this is situation is affecting her interests at the point that these issues have impacted the lives and property of herself and tenants. Mr. Cooney verified that there is no current license for this premises since June of this year. Ald. Coggs explained that the reason why notices were not sent out before because this license was not scheduled before committee ever before. The applicant asked Ms. Zappaterreno if she ever reached out to St. Catherine’s regarding these issues. Ms. Zapaterreno said that she has not. Amy Brengel - 1363 N Prospect Av – said that she has noticed the mess lately like activity in the cars, trash and that she reached out to Wendy about a month ago, and that she wonders if this is the issue for such a change in the neighborhood and that she is here to say that something is wrong with this premises. She also complained about not receiving the notice as building owner and that she understands the need of rooming houses but not at this area where taxes are very high. Ald. Bauman asked when did she notice the changes on the neighborhood. Ms. Brengel said that it started last year. Michelle Melstrand – 1312 N Astor St – said that she has seen women form St. Catherine’s doing drug deals right in front of the property, and that she keeps on cleaning the trash that these woman leave after, and that she and her tenant, do not feel comfortable coming home because these woman smoke pot and cigarettes in front of her house instead and not in front of St. Catherine’s. She added that she has reported it to district 1 as well. Matthew Geitner -1339 N Astor St – said that the big issue is that everything what the residents do is not in front of St. Catherine’s but in front of their homes. He asked if it’s a woman shelter because he has seen man leaving the building, and that he was allowed in and out with no questions asked. He also asked what kind of repercussions are for operating without a license and added that the legitimacy of this business is questionable because there are woman walking down the street at 2-3 am in with children in their strollers. Atty. Farris said that there are penalties. Ald. Borkowski about the staff present at the building. Ms. Weckler said that there are 2 full time property managers, 2 case workers and full time security. She added that there has been a lot of service calls and that they have changed the security company. Mike Spekh – 1319 N Astor St – asked how the organization verify that there are no children under 18 years old living there and that he is very unsatisfied with how this property is being handled. Amy Butterfield – 1322 N Astor St – said that she cannot go around the block without being asked for money and that she has witnessed much of what her neighbors have described, and that it is disturbing to have this feeling that she did not have before. She added that people hangs out on cars late at night and throw stuff to woman on the street and that the panhandling has increased. Individuals in support: Mary Lockwood – works for Impact – said that St. Catherine’s is one of the most needed housing providers in our city and that it is very successful in moving people to long term housing. Ald. Bauman asked if Ms. Lockwood have walked and toured the neighborhood. Ms. Lockwood said that she does. Jim Farrell – Pathfinder – said that he works for organizations to get people out of the streets and to provide housing for people in need, and that he is concerned about the neighbor’s testimony but that this organization does a good job transitioning women. Ald. Bauman asked Mr. Farrell’s advice on how to address the issues when tenants are telling him that they don’t feel safe and that they are asked not to call the police. He added that he cannot accept the excuse that we cannot throw 150 people because there is no accountability. Ald. Perez asked how many tenants use the case workers. The applicant said that 64 people are assigned to the case managers. Ald. Perez asked who determines the amount of cases per case manager. The applicant said that it is up to the director services but that it is about 30 cases for each and that they are handled case by case. Ald. Perez asked how the case managers are funded. The applicant said that comes from the rent revenue, county and organizations. Eric Collins-Dyke – Milwaukee Housing Division – said that they have worked with St. Catherine over the years and that this organization have been good in keeping folks off the streets and putting their lives together. Ald. Bauman said that he appreciates the work that Mr. Collins do and asked if he wants to give a free pass to the management. Mr. Collins said that they have to work and support the neighbors as well. Emily Kenney – works for impact – said that she cannot speak about what it has been happening around the neighborhood but that she can speak about the results of St. Catherine’s work. Sean Miller – Treasurer of St. Catherine’s – He said that he understand that some of the issues are believed to come from St. Catherine’s. He added that he lives in the area and that he has noticed the changes of the neighborhood as well. Ald. Bauman asked the applicant when that last board meeting happened and why they did not know of any of these issues? Mr. Miller said that it was back in June. Nancy – Salvation Army – said that St. Catherine is a great program. James Mathy- said that they will work on all of the issues addressed today. Andi Eliott , Jennifer Atkins and Jeff Musa were in support as well. Ald. Bauman - said that he likes the plan about presenting on how these issues will be resolved and thanked Mr. Musa. He also asked when is the plan going to be ready for committee’s review. He also asked the committee to hold this application until this plan is seen before moving forward. Ald. Coggs asked if the applicant agrees. Ms. Weckler said that she agrees. A number of residents testified in support of St. Catherine’s. Steven Mahan – said that there will be a plan to move forward for this facility and that he understands the issues with the transfer of the property. He said that he wishes the passage of this license because of the funding that it is going on, and that he wants to make sure that they will bring this building in compliance. Ald. Perez asked Mr. Mahan what he meant with working with other agencies. Mr. Mahan said this application is about funding which is also a low income property. Ald. Perez said that it is because about service calls, neighbors and community. Mr. Mahan agreed that everyone must be taken seriously. Ald. Perez said that 109 service calls are a lot and that is the reason why we have neighbors here. Ald. Borkowski moved to hold the application to the call of the chair. There were no objections. Individuals also present: Ald. Bauman said that there is a pending litigation about these 4 properties with the only objector being the one who has sued the city for damages and asked Atty. Farris how to proceed. Atty. Farris said that the application must be heard. Individuals in opposition: James Dieter – gave a summary of the activities over the years with these 4 properties. Ald. Borkowski asked Atty. Farris if Atty. Robin Pederson and Atty. Julie Wilson are available to continue with this hearing, and that these applications should be discussed in closed session. Ald. Coggs asked Officer Novak why none of these calls made it to the police report. Officer Novak said that there is no reason and that they are CAD calls. Mr. Dieter said that he cannot believe that there is nothing on the police report and that the people living at these properties are sex offenders, criminals that are affecting his neighborhood, and that he does not understand why he cannot testify on the crime that is going on. He added that he does not know what are we are waiting for to happen. 3119 W Wells St – he said that he is very familiar with the area and that he appeared at the last hearing to talk about what was going on back then, and that he knows that there is a bid where his tax dollars are going. He added that he sold his property because people from the Clark House were camping at his front lawn and passing out on the street, reasons why he got tired and sold his house. He said that he does not understand why these rooming houses still operating and that it is time to do something and requested to shut it down. 3209 W Wells St – she said that she got a report from the Department of Neighborhood Services requesting to have her house painted and driveway repaired in the month of March back when she bought her house. She asked why she was taken to the court twice while nothing has been done with these properties. Ald. Bauman asked if there is some standing DNS reports on the applications. Mr. Cooney said that there are no reports from DNS. Rick - 3209 W Wells St – said that he has worked very hard to make a better neighborhood than it was when they moved in. Charles Smith – 911 N 24th St – he said that he testified at the last meeting and that the committee voted unanimously not to grant the licenses for these properties but that the licenses were issued anyways. He added that he has surveillance cameras, and that he has footage of people living on those rooming houses breaking in the cars, doing drugs in front of his house, throwing garbage and that he has been threaten when he tells them something. He added that the mail carriers and delivery services have been chased down the street by the people living in the rooming houses as well. He said that he is concerned about the school as well and that he does not understand why they are operating still. He said that the city is not accomplishing anything with these properties. Atty. Coggs said that she understands that it could be a made up but, that the police could have verified that what it was said it happened. Ald. Spiker said that it does say on the extended version of the report, that the police was not able to retrieve the video while the officers were on the scene and asked Atty. Potter what has been done to provide help to the police when is needed. Atty. Potter said that the general managers (not the shift managers) have password protection over the surveillance cameras but that he does not know the circumstances at that specific moment. He added that they manage +270 stores in the country and that they have provided the footage for other instances and that he will follow up to learn more about this situation. Ald. Borkowski said that he undertsands that his job is to represent Taco Bell but that he is here to represent the citizens of Milwaukee and to make sure that businesses are safe for the people of Milwaukee. Ald. Perez asked Officer Novak if there is evidence that it was an employee involved or not involved on the shooting. Officer Novak said that he did not have a chance to review the related reports. Ald. Perez said that it is possible that an employee got away with a gun and firing shots. Atty. Potter said that Taco Bell made an internal investigation and that no weapon or gun shots were found but that he does not know what it was done in particular at this location. Atty. Farris from the City Attorney’s Office said that this item can be left open until the questions are answered. Officer Novak said that physical evidence was recovered from the parking lot after reading the extended version of police report. Atty. Potter asked for a copy of those extended versions reports. Ald. Spiker said that he has concerns about three shooting incidents around the Taco Bell building and that he is worried about the extended hours even if the incidents happened during the daylight. Atty. Potter that they secure the lobby at 9pm and that now they have a bullet proof window. Ald. Spiker asked Atty. Potter is he is willing to reflect what he just said on the plan of operations. Atty. Potter said "yes"/ Ald. Spiker moved to amend the application to reflect that the lobby will close at 9 pm and that only the drive thru is available during the extended hours license. He added that there are cameras all over the place and that there are woman managers now and that there are no accusations under this management. Atty. Maistelman said that there is a procedure in place and that it is reflected on no putting anyone under unemployment for the past two years. Ald. Jessica Jaglowski - 3019 N Prospect – said that there is a strong family presence on her neighborhood with about 30 children playing and riding scooters, bikes, etc. on her block only. She said that there are a lot of stores like that on Oakland Av but that a liquor store is not a good fit for her residential area. Angeline Koch - 2951 N Prospect Av – said that she wants to make sure that her objection is recorded and that the high school students deserve to have a family neighborhood vibe and that she is concerned about the property value being affected for having another liquor store. Joyce – asked why the store is named Serenity420 Ald. Coggs said that those kind of questions will be answered at the neighborhood meeting. Marc Tasman – 2001 E Newberry Blvd – said that he opposes because he will be in the middle of two alcohol licenses and that there are also elementary schools around the area. He added that he is concerned about the college students having access to delta products (cannabis) which are unregulated. Kevin Walzak – 2767 N Frederick Av - said that he is neighbor and president of the neighborhood association and that he wanted to let committee know that they are in opposition of this application and that he is looking forward to have the neighborhood meeting when the new elected official comes to the office. He added that he agrees with all of the points that were mentioned before. The applicant said that he would like to defer to the November meeting. Ald.
