(Expires 5/21/2023) The applicant was present and said that regarding the incident on the police report, he was not at the store and that his brother did not know what happen outside. He added that the injured person came to store and that he rejected that his brother call 911 for him. He also said that his brother was uncooperative with the police because he does not speak English well and that this is the first incident in 20 years. He mentioned that he has a good relationship with the neighborhood. He added that he told his brother to call 911 if something like this ever happens again. Individuals also present: Ald. Borkowski said that this issue is significant and that there is no excuse for not reporting this incident to the police. Ald. Brostoff said that it does not matter who is at the store, that the standards should be the same. The applicant said that this incident was not related to his business. Individuals in support: Christopher Woods – 2807 N 29th St - said that the police report is wrong because there was no gun inside the store and that he has the video of the guys beating the victim up and then shot him at the leg and, that everything happened outside. He said that he talked to the police officers and that he shared the video and photos of the vehicles with the police. Mr. Ellzey asked Mr. Woods if he received a sort of receipt from the police after sharing the videos and photos. Mr. Woods said that he would need to check with his daughter. Ald. Coggs asked to Sgt. Velasquez to verify what the witness just said. Brittney Thompson – she said that she has lived there for 35 years and the she is also a community advocate. She added that the applicant is always giving back to the community (children and church). Bryan Moody - 2862 N 30th St – said that he knows the applicant since he was a little kid and that he is a good person all around. Ald. Borkowski asked the applicant if he has security guards. The applicant said that he does not need them because he has a good relationship with the community. 832 N 25th St #6 – he said that the applicant has been a good motivator in his life and that he always reached out to him to talk. Sharon Jackson – 3021 N 29th St – said that he has been the applicant’s customer since he was a kid and that he has helped a lot of people. Denisse March - 2823 N 29th St – said that the applicant has been always respectful to the people and his business. Danita Lancy – said that the applicant is a good friend of the neighborhood. Will – said that he goes to the store every day and that he was there the day of the incident and that the applicant is always honest and good to people. Mr. Ellzey thanked the community for coming to support this license and that he agreed with Ald. Borkowski regarding the weapons but that he wants to hold this application to verify that the incident did not happen inside the store as the witness said. Ald. Minutes note: 10 REDMOND, Briana NICOLE, Agent for "The Amani Place LLC", Class B Tavern and Public Entertainment Premises License Applications Requesting Instrumental Musicians, Disc Jockey, Bands, Karaoke, Poetry Readings, Patron Contests, Comedy Acts and Patrons Dancing for "The Amani Place" at 401 N 35TH St. The applicant was present. Individuals in opposition: Bernard Runo - 3405 W St Paul Av – said that his house it is a block south from this proposed and that they have a lot of illegal activity with the concerts from “The Rave” (despite the distance) and baseball games. He also said that there was a shooting on April 15th on 24th St., and that these activities happened without having a bar in the area and that he is concerned about how things are going to evolve. He also that he has seen people urinating and defecating on his front lawn. Mr. Cooney said that the License Division received an amendment yesterday and that is not on the record. Ald. Pratt moved to amend the plan of operation to stop alcohol sales and entertainment at 10 pm and that the alcohol sales would not be more than 12% ABV. Lucy Cooper – 215 N 38th St – she said that she sent a letter on February 28th and that she appreciates the fact that the applicant took into consideration what was discussed at the neighborhood meeting but that she still opposes to this application. She read the letter sent to the License Division (on file). She added that they have worked very hard in order to improve the neighborhood. Barbara - 3840 W Mt. Vernon Av – said that she just bought her house in the neighborhood and the reason why she invested in there is because of the strong neighborhood association. She said that they have mobile drug deals all the time because of the location of the neighborhood and that a bar will increase the speeding issues among all of other things. She added that a bar will degenerate her neighborhood. The applicant asked the witness how often she is out late at night to testify that TJ’s is not open. The witness said that TJ’s bar is only open for Packers games. Ald. Murphy agreed. Peggy Falsetti - 318 N 38th St – said that she has lived there over 48 years and that she does not like the idea of having a bar again because it always evolves in negative situations. India Pryor – 312 N 36th St – said that she is a homeowner and that she owns a family daycare 300 feet from the proposed application. She also said that her entire block has been rehabilitated and that they already have issues with Marquette students at late hours. She said that she will need to walk across the proposed bar to go the park with the children under her care. She added that the mobile drugs dealers feel so comfortable that they do not care about the neighbors and that a bar will make it even easier for them. Ald. Coggs said that this witness brought up that her daycare is less of 300 feet from the proposed bar and asked Mr. Cooney if DNS checked this fact. Mr. Cooney said that it was referred to DNS and that it did not report back that the establishment was 300 ft from the daycare and that the criteria that is used for this measurement goes from the front door of the proposed establishment, along the public right of way to the front door of the church, daycare/school, hospital, etc. Sharlen Moore – 32nd and Michigan St – said that her neighborhood is interested in building a strong community and that they are being trained on how to be a stable and sustainable community and that a bar is not a good fit. Anna Stone – 452 N 41st St – said that this is her neighborhood and that she supports her community and that they all want each other to succeed raising their families and caring for the elderly. Valerie Langston – 201 N 36th St – said that she has the feeling that it would be a corner bar with a lot of activity based on the information reflected on the application. She added that they have worked very hard for the quality of live that they have built and that they deserve to enjoy it. She also said that she has lived in the neighborhood for 26 years and that she calls Ald. Murphy’s office twice/month answering to Ald. Murphy’s question. Tim Cigelske - 3401 W Wisconsin Av – Marquette University High School – said that he supports the neighbors and that this bar would be right by the practice fields as well. Sherrie Tusler – 3402 W St. Paul Av – she said that she respects the fact that the applicant has bought the building but that she opposes to the alcohol license because of the location right on the park. She added that there are two alcohol business operating without licenses and that they are concerned about the neighborhood and the children. Asia Carter – 425 N 34th St – she said that she is opposing because this same establishment was rented without being licensed. She added that crazy stuff already happened without any alcohol and, that more crazy stuff will happen when alcohol is involved. She added that they have asked the applicant to be there but in a different capacity. Precious S Bradan - 222 N 33rd St – said that this neighborhood is going on the right direction and that a coffee shop will be supported. Individuals in support: Tyler Gray – lives upstairs - said that he just moved to Milwaukee to redesign the entertainment line for the Brewers and that he thinks that there is a little of misinterpretation of the concept. He added that parking is not an issue because there are only 2-3 cars the entire day. Ald. Murphy asked the witness for how long has been in the neighborhood and if he has attended any of the neighborhood meetings. Mr. Gray said that since February 18th and that he did not attend the meetings but that he is here today. Nicole Grace – (applicant’s co-worker) said that she worked with the applicant and that their plan is to offer a creative space and that hearing all these people’s testimony is like they live in Brookfield and not off from 35th St. where prostitution is an issue. Individuals also present: Ald. Murphy said that we heard a lot of testimony from a diverse working class neighborhood. He added that he held the neighborhood meeting on April 18th and that the response was in objection. He also said that he was asked to talk to the applicant to find a different a capacity. He said that the applicant is renovating the upper level as a residential space and that they will support the applicant to find a different use with the help of the City. The applicant said that she did not heard from any of the neighbors after the neighborhood meeting and that the space won’t be used as an open bar. She added that her idea was to have a rental space with refreshments service and to beautify the corner. She also mentioned that the space is not that big. Ald. Coggs asked who is going to manage the business. The applicant said that either her sister or parents. Ald. Brostoff said that the applicant has a business operating at his district and that she does a great job over there but asked if her family has experience operating an alcohol license. The applicant said that they do not have experience and that she does not want bad vibes associated to her name. She added that she is a full time employee, mother and that she wants to have a clean business. Ald. Coggs said that she does not know the applicant but that she knows people that speaks highly about the applicant but neighbors will be paying attention to her business and that she will set for failure because she will be here every year. She asked the applicant to reconsider the use of the building. Ald. Murphy said that he support the neighbors because it was the objection was unanimous. He added that the applicant is showing that she is interested in the neighborhood by renovating the upper level and that the neighbors and he are committed to support the applicant in a different capacity. The applicant said that the property is zoned as tavern and that it was a tavern before and that she does not the story of the building. Ald. Coggs told the applicant to request the police records to MPD. Ald. Brostoff said that his experience with the applicant has been excellent at his district but listening to the neighbors is not a good fit for the area. Ald. Brostoff moved denial of the Class B Tavern license application based upon the neighborhood testimony and to hold the Public Entertainment Premises license application. There were no objections. She added that the applicant is working with the employees to make sure to report any kind of incidents to the police. Brostoff said that many incidents have come out in a short period and that firearms should not be the reason to rebranding or beautifying but regular maintenance. Ald. Brostoff asked if there is something wrong with the police report because it says that the door was not locked to keep the employees and other patrons safe. The applicant said that the armed guy was in and out but the employee could not do anything because it was too fast and that the City of Milwaukee does not allow to have the emergency button to lock up the place due fire and safety issues. Ald. Coggs asked the License Division, City’s Attorney and MPD if they know about this rule. Sgt. Velasquez said that she heard that it was a fire and safety issue but that she does not know if there is an ordinance. Mr. Cooney said that he will ask the Department of Neighborhood Services. Ald. Brostoff asked the applicant if he has ever had these types of issues before. The applicant said the he has not. Ald. Pratt asked the applicant if he has security guard on-site. The applicant said that he has a security guard and a vehicle on the premises. Ms. Martin from the License Division said that the current plan of operations does not reflect the security guard and vehicle. Ald. Pratt moved to amend the plan of operations to have a security guard on site and a security vehicle during all the hours of operation. Ald. Pratt moved approval as amended with a warning letter based upon the preponderance of the evidence in the police report that demonstrates the operation results in a threat to health, safety or welfare of the public.
