Substitute motion modifying Milwaukee Police Department Standard Operating Procedure 460 - Use of Force.
Analysis
This motion modifies Milwaukee Police Department Standard Operating Procedure 460 - Use of Force to specify that police officers will immediately render or request first aid to an injured subject following a use of force, regardless of which law enforcement department or agency carried out the use of force.
Body
Whereas, The purpose of Milwaukee Police Department Standard Operating Procedure (SOP) 460 - Use of Force is to provide instructions for the proper use of force by police officers, provide a fair and impartial review of use of force incidents, and determine whether the actions of police officers were justified; and
Whereas, SOP 406 also provides instructions to police officers for rendering and requesting first aid following a use of force, but does not specify that treatment of a subject shall occur regardless of whether the use of force was carried out by a Milwaukee Police Officer or a law enforcement officer from a separate jurisdiction; and
Whereas, In situations where a subject has been injured, it is important that members of the Milwaukee Police Department act to render or request first aid immediately, regardless of who caused the injury through a use of force; and
Whereas, S. 62.50(3)(am), Wis. Stats., allows the Common Council to suspend or modify any policy established by the Chief of Police upon a two-thirds vote of all of the members of the Common Council; now, therefore
It is moved, By the Common Council of the City of Milwaukee, that Section 460.45(C) of the Milwaukee Police Department’s Standard Operating Procedure 460 - Use of Force shall be modified as follows:
