Presentation was given by the development team on specifics of the development project.
This zoning change was requested by Jeffers Block 5 Partners, LLC and will allow construction of a 5-7 story mixed-use building with ground floor commercial space and approximately 269 market rate residential units on the upper floors. The 7-story volume is located on the south portion of the block and the 5-story portion is on the north side. The residential component of the building will be equipped with a ground floor resident lobby, fitness area and outdoor rooftop space, and on-site management offices, among other amenities. A 278-space parking structure that will be utilized by the residents is located at the center of the block, mostly concealed by the building. The northern portion of the block includes an outdoor plaza on the northeast corner and a Milwaukee Area Technical College (MATC) fieldhouse to the west.
There was discussion regarding rentals (unit costs, mix, and size), fieldhouse operations and usage, traffic logistics, parking count, loading/unloading/drop-off areas, accessibility, bus usage, plaza (activities, protective buffers, and size), retail/commercial spaces, outside lighting, masonry facade design and material on the northern corner, and amenities and community space.
Providing public testimony:
Albert Brown, resident, testified with no objections and inquired about affordability and human/minority resource requirements on the project.
Commissioner Washington moved conditional approval, seconded by vice-chair Nemec. (Prevailed 7-0)
Conditions:
Conditions specified in staff report, including applicant continuing to work with DPW and DCD on the final plaza design, loading areas, and submitting updated exhibits that incorporate comments previously provided by DCD and DPW. Applicant to also submit information for review by DPW regarding traffic/parking plans for times when events are held simultaneously at proposed new venue and existing neighboring venues.

Phillips Avenue, in the 6th Aldermanic District.
Analysis
This zoning change was requested by Jeffers Block 5 Partners, LLC and will allow construction of a mixed-use building on the subject site.
Body
The Mayor and Common Council of the City of Milwaukee (“Common Council”), do ordain as follows:
Part 1. There is added to the Milwaukee Code of Ordinances (“Code”) a new section to read as follows:
(1) In accordance with the provisions of Section 295-907 of the Code relating to the establishment of planned development districts, the Common Council approves the subject Detailed Planned Development, which is restricted to the time limit of 5 years from the effective date of this ordinance unless the criteria per s.295-907-2-c-12 are met as referenced in Exhibit A, a copy of which is attached to this Common Council File which is on file in the office of the City Clerk and made a part as though fully set forth herein.
(2) The zoning map is amended to change the zoning for the property located at: 300 West Juneau Avenue, Tax Key No. 361-0409-110; 1225 North Dr. Martin Luther King Jr. Drive, Tax Key No. 362-0470-100; 1245 North Dr. Martin Luther King Jr. Drive, Tax Key No. 362-0469-100; 1224 North Vel R. Phillips Avenue, Tax Key No. 362-0471-100; and 1244 North Vel R. Phillips Avenue, Tax Key No. 362-0468-100 from General Planned Development (GPD) to a Detailed Planned Development (DPD).
(3) The requirements set forth in said detailed plan attached to this Common Council File as Exhibit A, constitute the zoning regulations for the area contained in such planned development district described, provided further, that the effect of the approval of such detailed plan is that such plan shall limit and control construction, location, use and operation of all land and structures included within the detailed plan to all conditions and limitations set forth in such detailed plan.
Part 2. Any persons, firm, company or corporation owning, controlling or managing any building or premises wherein or whereon there shall be placed or there exists anything in violation of the terms of this ordinance; or who shall build contrary to the plans or specifications submitted to and approved by the Commissioner of the Department of City Development, or any person, firm, company or corporation who shall omit, neglect or refuse to do any act required in this ordinance shall be subject to the penalties provided in Section 200-19 of the Code.
Part 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions. The Common Council declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase or portion irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases or other portions be declared void or invalid.
