(Expires 7/27/2022) The applicant was present along with Atty. Michael Maistelman Individuals also present: Lydia Hernandez – said that she is here to testify that her daughter died on the premises due a drug overdose on 4/26/2021 at the hands of a drug dealer and that this establishment is a place to harbor crimes like drug and human trafficking and that she does not know why there is no police report about her daughter’s death. Cathy Taylor – said that this place has been a nuisance and that it was her niece who passed away in that hotel and that she is in objection. Whitney Miranda – said that she stayed at the hotel after the passing of her cousin just to observe and that she saw firsthand drug transactions and that the establishment is not safe because people come and go and they are loitering around with no security on the premises, that everything must be repaired. Atty. Maistelman asked the applicant when she stayed there. Ms. Miranda said that she stayed one or two months after her cousin’s passing. Atty. Maistelman asked Ms. Miranda if she called the police. Ms. Miranda said that she did not call the police and that she was there to observe what the hotel was about and that she saw a room next to the check in area full of ladies. Individuals also present: Ald. Dodd said that she wanted to give the condolences to Mrs. Hernandez and that she is concerned about why this item is not on the police report and asked if there is a record of the call. Sgt. Velasquez said that there is a call for service for a drug overdose on 4/26/2021. Mr. Cooney said that the incident is not shown on the last year report either. Ald. Spiker asked Atty. Maistelman if his client acknowledges that the overdose happened at the hotel. The applicant said that yes, it happened. Ald. Spiker asked if the staff reported the incident. The applicant said that it was another guest who reported it. Ald. Coggs said that human and drug trafficking are common issues for hotels in the city and asked the applicant what has been done about it. Atty. Maistelman said that they don’t take cash as a form of payment, that a state id is required, licenses plates are checked and a quick ccap check are practiced. Ald. Coggs said that a training is recommended for the staff to be aware of any suspicious activity and how to address it. Ald. Spiker agreed that a training is needed and to get in touch with other hotels to check what are they are doing. Beer Shah – the applicant’s son - said that they are trying to do a do not rent list of people not allowed in the hotel and that they are sharing this list with other hotels in the area in order to set up a network to address this issue. Ald. Spiker asked if there has been any other drug overdose case. Beer Shah said that it never happened before and that the person who died never shown signs of being in trouble. Ald. Dodd said that she is still concerned about the fact that the applicant did not call the police and that the applicant knew that this family was going to show up at the hearing without doing any outreach. She added that it is concerning that the applicant does not know if the police showed up and that based on the information that we are getting at this committee, that the applicant has not shown signs on even reaching out to the family. Atty. Maistelman said that the problem is that we do not have a police report and that he cannot put up a plan to defend his client without it and that nothing has happened within the last year and that the committee should discipline everyone with the same criteria as other hotel licenses that have been under the same situations or worse. Ald. Dodd said that she appreciates that Atty. Maistelman tried to make a case for his client and that the difference is that we have a mother who lost a child in front of us instead of the police report and that if this item would have shown up on last year police report, there would have been a progressive disciplinary action instead. Ald. Dodd moved denial based on the applicant and public testimony. (Prevailed 3-1)

Individuals also present: Ald. Zamarripa said that one neighbor sent a letter that should be part of the file and that she got 4 contacts from neighbors who oppose to the license renewal. She said that she is very disappointed with the applicant and the attorney because no agreements have been made and that she has heard the attorney say that some changes have been made but that she was not informed about those changes until today despite the meetings and calls that they have had. She added that on her last communication, she made the request to close earlier and that she was told that most of the revenue comes from the late hours so that it was a straight no. She said that this establishment is handled more like a nightclub and that at the last committee meeting, she pulled out the facebook page which advertises tequila nights, ladies nights, DJ nights and that she has heard from constituents that they offer VIP bottles which is a very nightclub thing and that's the reason why they refused to close early as they have acknowledged that most of the revenue comes from this clubby thing. Ald. Zamarripa also mentioned that she asked the applicant to change the security company and that Marcos said that it was hard to do it and that the DJ who punched the patron still works there and that for all those reasons she recommends not to renew the public entertainment premises licenses due the lack of cooperation to negotiate and for the unapologetic attitude to the public and that she advocates for a 30 day suspension for the Class B and Food Dealer licenses. Atty. Mirza said that the name on the letter has been redacted and wanted to confirm if it's from the same person who appeared at the last hearing, Mr. Miranda. Ald. Zamarripa said that the letter is not from Mr. Miranda but from a neighbor who lives in the 8th district. Ald. Spiker asked if it’s a night club. Atty. Mirza said that it is a restaurant bar that switches operations like a nightclub type environment and that on Friday and Saturday nights there is DJ involved which is listed on the application as well as karaoke, patrons dancing and mariachi. He added that the hours of operation have been listed from 10am to 2am Mon - Thur and that on Fri & Sat the establishment closes at 2:30am. He added that his client is attempting to improve security and that there is a significant revenue that comes after 12:30am from the bar scene which will be a loss of revenue for his client and that he has changed security companies, that the pepper spray is no longer part of the policy and that his client has engaged with an individual from the police academy who makes private services and that he does not know how is it going to work from now on but that he is trying. He added that they have implemented rules that no one can enter after 1:45am and that there are security cameras all around the premises and that the hours of operation could change at 2am like the rest week. Ald. Spiker said that it seems to be that on Fri and Sat nights it is operating as a nightclub and that the rest of week it is operating as a bar and restaurant but that to dine at 2am is oddly and to objecting to close early during the week days is tied to needing the revenue as a bar. Atty. Mizra said that the current closing time on Mondays, Wednesdays and Thursdays is at 11pm and that on Taco Tuesdays they are open until 2am as well as for Sundays and he agreed that the application can be amended to reflect the reality. Ald. Spiker noted that the three incidents on the police report happened after midnight. Atty. Mizra said that his client knows that he must implement safety procedures and that he has the right to operate his business with full respect to the community. Ald. She said that she lives across the street as well and that just looking at the window she sees people standing and doing nothing or having fights, drug dealing, smoking cigarettes while pumping and that she has reported it to the police and that the police is not responding and that she opposes to the extended hour license as well Kate Halfwassen – said that they have lived in the area since 2008 and that she is afraid to fill in there because it is gross. She said that there is people loitering, used condoms and bottles filled with pee on the floor and that she does not feel safe there. She said that she wanted to give a clear picture of how discussing the area is and that she opposes to the extended hours license as well. Doug English – 423 E Garfield – said that he has been a resident for almost 18 years and that he does not want the extended hours license for the same reasons as everybody else and that during the winter months, they do not remove the snow at all which is not safe for older people like him. John – said that he opposes also to the extended hours license because of the noise coming from cars and motorcycles gathered at the gas station and that this issue was reported to Ald. Coggs back in June and that the applicant does not show any pride for being in the neighborhood because he did not offered any solutions to move forward. He added that yesterday they found out that the owner has been only about 20 times at the business that he owns since 5 years ago. Patrick McElwee – 2230 N Baldwin St – he said that he agrees with everyone who has spoken on the last half hour and that he opposes to the extended hours license as well. Claire – 2221 N Buffum St – she wanted to point out that there are 5 bus stops at this intersection and that these issues are also impacting the transportation users and that she does not feel safe while waiting for the bus and that she is in opposition of the extended hours license. Teresa Turner - 521 E North Av – said that the has lived there for 20 years and that she has seen the declining on the past 2 years and that she does not feel safe there. Individuals in support: Ryan Champagne – said that he had a chance to speak with neighbors and business owners and that he bought half block there and that it has been a rough neighborhood and that is why he makes a call to the city to invest in the area. Added that safety is his major concern and that in fact, his wife wants to open a doggy daycare and that her clientele must feel safe dropping their dogs off and because he believes that, we can grow together because our city is rich in culture, rich in neighbors, etc. He also mentioned that some problems come from properties owned by the city and the police not responding on time to the service calls but that meetings like the one held yesterday, are a step on the right direction. He added that what Mr. Grewal is proposing is a good compromise and that they all need to work together to make it better and safe community. Monica Champagne – 2764 N Buffum St – business owner across the street from the gas station and that she wants to see a better and quicker response from the law enforcement. Aida Gonzalez – said that she has lived next door for the last years and that she has seen that the people who causes problem are not customers from the gas station. She added that her client recognized that he needs to spend more time at the location, that he has contacted the property owner for landscaping improvements and to close at 2am during the summer months. She said that she thinks that the plan of action and the employee handbook presented today are a good compromise with the neighborhood and that his client wants to move forward if the licenses are approved. Ald. Coggs said that lack of cleaning was one of the issues and wanted to check with the license division how many times a day they will do it because it is not reflected on the plan of action submitted today. The applicant said that he has worked with the issues from the patio speakers, which is the first item on the police report, and regarding the second item, the applicant said that he was not present at the moment but that he is familiar with the patron who seems to have mental issues and who refused to leave the sidewalk. Individuals also present: Nasser Musa – (Manager) - said that he was present when the patron had the mental wreck down and, that the patron was not touched by the staff and that she was just being escorted on her way out. Atty. Obviagele asked the applicant if the incident from 6/20/22 happened after business hours. The applicant said that it happened after business hours and that he arrived as soon as he could. He said that the detectives and police were on the premises and that he helped them to retrieve the surveillance videos and that the deceased person was an employee. The applicant added that he reached out to the family of the deceased employee and that he provided a place where to grief to the family and the community. He also said that he is being trying to have a safe place where everyone is welcome. Individuals also present: Ald. Spiker asked regarding the August 4th incident – if Mr. Musa has shared his telephone number with his neighbors. The applicant said that he has and that the Alderperson and police know that they can share his personal cellphone number with the neighbors. Atty. Obviagele said that neighbors would get a response in real time because either the applicant or someone else will take upon it. Ald. Spiker said that the reports from neighbors are very consistent with previous years of people making noise, leaving the bar and hanging out by their cars. The applicant said that the what’s app thread is meant to share any concerns and that the signage is going to be engaging patrons to be in compliance with respecting neighbors, no loitering and that he takes complaints from neighbors seriously. Ald. Spiker asked when the security guard was hired. The applicant said that he has had security over the years. Atty. Obviagele explained that they have increased the security since last year and that the metal detection equipment was not used because the incident happened after business hours. Ms. Musa (Manager) said that they were not using it because the patrons were frisked by hand which they find more efficient and faster on the busy nights. Ald. Spiker asked how the security guard had a gun when he was not supposed to. Atty. Brown said that the security guard received the ccw while being in probation. Ald. Coggs asked what the plan of operations says about security measures. Ms. Byrd said that metal detectors and bag searches are listed on the application. Ald. Coggs asked the applicant if he is willing to amend the plan of operations with doing hand searches starting at 8pm. Atty. Obviagele said that they are willing to do so. Ald. Spiker moved to amend the plan operations including doing hand searches starting at 8pm. Individuals in opposition: Tiffany Markwardt – said that no more neighbors are present because they just received the notice last Friday and that her community still have the same issues as last year but that they are not linked to Casablanca because the incidences happen either on Cass St and/or along on Brady St. She added that the applicant has not complied with the agreement from last year (closing earlier) and that she has missed work two times this year because of the shootings. She added that she lives across the street and that she already had a bullet going thru her house last year and she does not feel safe every time that a fight breaks up like it just happened recently. She said that she has seen patrons either leaving or entering the place making noise, littering, being loud and driving in the wrong direction on Cass St. She mentioned that they do not have parking available because Casablanca patrons take all of the street parking and that the noise is every day of the week. Ald. Spiker asked if the incidences happened after closing time. Ms. Markwardt said that happened after 10 pm and that her neighborhood is a young family neighborhood with children that cannot sleep at night because of the issues with Casablanca. Matthew Anchor - 804 and 808 E Brady St – said that he is the property owner of these two residences for over 20 years and that he has not been contacted by Casablanca at all. He added that the last couple of years have been a rampage of issues coming out from Casablanca and that he was there for a week while doing renovations in his building and he witnessed crazy behaviors from the patrons from Casablanca. James Lewis – 1693 N Cass St – said that he has lived over a year there and that all the parking spots are compromised. He added that that he has seen patrons coming out from Casablanca breaking in cars and that his dogs bark a lot because of all the commotion from this business and that he has videos to support his testimony. The applicant asked Mr. Lewis if he is willing to join the what’s app group. Mr. Lewis said that he would join it if he gets a telephone number to add. Jaden – Lives on Humboldt and Brady and that he stills deal with the same issues that his neighbors and that he thinks that closing earlier will not solve the problems. Individuals in support: Prabhu Kasthuriangaian – said that he lives on Humboldt Blvd and that he has reached out to the applicant to share the same concerns as the others neighbors and that Mr. Musa took the time to explain him a plan and that he feels comfortable with it. Sedan Smith Sr – 4271 N Sherman Blvd - Said that he is the nephew of the deceased person and, that the applicant and his business sheltered him for grieving, and that this business is a representation of a community where everyone gets together. Servant Ventae Parrow Bay - 1312 N 13th St – said that he was part of the grieving experience. Shaterri Dotson - 2821 N Vel R Phillips – said that the service and the presence of the applicant are always good and that she feels welcome all the time. The following person were also in support: Ethan Bexley, Icaro Harris, Jasmine Griffin, Matthew Griffey, Minister Caliph Muabel. Danny Graybell, Thomas Holmes, Sandy Gallagher, Fadi Kurdi, Mia Fowler, Brandon Merino-Reyes, Jesus Ayala and Brenna Clarke, David Olson, Jennifer Schulheis and Cole Cobb. The applicant thanked the community for the opportunity of being here and said that he will reach out personally to the neighbors through what’s app platform or direct phone number. He added that violence is a disease that needs to be treated as such and that he encourages businesses and neighbors to have an open dialog in real time to address these issues right away. Atty. Obviagele said that the gun violence or the parking issues are not because of Casablanca. He added that many new apartment buildings do not have enough parking spaces and that we cannot let those who cause crime or disturbances to win by punishing business. Ms. Cervantes said that over the course of the year they received many emails from constituents with the same issues as the neighbors who participated today and, that she encourages the applicant to continue working with the Bid and neighbors. Ald. Borkowski moved approval with a warning letter based on the police report and on the willingness for the applicant to make a change working with neighbors and community.
