Title
Substitute resolution approving annexation of territory to Business Improvement District No. 8 (Historic King Drive), in the 6th Aldermanic District.
Analysis
This substitute resolution approves expansion of the boundary for Business Improvement District No. 8 (Historic King Drive), which expansion area is to the North and West of the BID’s existing boundary line and is generally bounded by 7th Street on the West, McKinley Avenue on the South, Capitol Drive on the North, and 2nd Street on the East.
Body
Whereas, An owner of real property used for commercial purposes has petitioned the City of Milwaukee for annexation of territory (commonly known as expansion of the boundary) to Business Improvement District (“BID”) No. 8, as authorized by Section 66.1109(2m)(a), Wisconsin Statutes; and

Whereas, Notice of the annexation and a boundary map showing the territory to be annexed, a copy of which is attached to this Common Council File, were sent by certified mail to all owners of real property within the proposed territory to be annexed according to Section 66.1109(2m)(c), Wisconsin Statutes; and

Whereas, The City Plan Commission (“CPC”) held a public hearing on said annexation that was properly noticed by publication of a Class II Notice under Chapter 985, Wisconsin Statutes, and it approved said annexation of territory to BID No. 8 according to Section 66.1109(2m)(b) and (c); and

Whereas, Within 30 days after said CPC public hearing and approval, the owners of property in the territory to be annexed may file a petition with the CPC protesting the annexation according to Section 66.1109(2m)(d); now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that no such valid protest petition was received by the CPC, therefore, the annexation of territory to BID No. 8 is approved, which proposed territory is to the North and West of the BID’s existing boundary line and...
