Title
Resolution authorizing an easement with Wisconsin Electric Power Company on City of Milwaukee property at 823 South 4th Street, in the 12th Aldermanic District.
Analysis
This resolution authorizes an easement for underground gas equipment on a City-owned property.
Body
Whereas, The Wisconsin Department of Transportation (“DOT”) is planning substantial construction of West National Avenue between South 39th Street and South 1st Street over the next few years, and the DOT is requiring the City to replace the current gas line; and

Whereas, Wisconsin Electric Power Company, doing business as We Energies, is proposing to relocate the new gas main around the pedestrian tunnel entrance at the Southwest corner of West National Avenue and South 4th Street on the grounds of the Milwaukee Public Schools (“MPS”) Escuela Vieau School, located at 823 South 4th Street (“Easement Site”); and

Whereas, To accommodate the easement, We Energies has requested an underground distribution easement (“Easement”) at and across the Easement Site; and

Whereas, A copy of the Easement and related map is attached to this Common Council File; and

Whereas, We Energies agrees to pay $1,145 for the Easement; and

Whereas, The compensation presented by We Energies has been reviewed by the City Real Estate staff and the offering values have been determined to be reasonable consideration for the Easement; and

Whereas, Legal title to MPS real property is held in the name of the City, in trust for MPS, and conveyance of MPS property and property rights requires adoption of a resolution by the Common Council approving such action; and

Whereas, The Department of City Development and Department of Public Works has reviewed the Easement and recommends approval; now, therefore, be it
