Analysis

This resolution authorizes and directs the proper city officers to execute sewer easement releases, SER-1541A, SER-1541B, SER-2590 and a conveyance document, QCD-2770, all located in vacated South 5^th Place from West Harrison Avenue to West Cleveland Avenue.

Body

Whereas, On December 1, 1961 the City of Milwaukee was granted sewer easement SE-1541A, located in vacated South 5^th Place from West Harrison Avenue to West Cleveland Avenue, being portion of tax key number 498-0807-211 by Chicago North Shore and Milwaukee Railway; and

Whereas, On December 1, 1961 the City of Milwaukee was granted sewer and water easement SE-1541B located in vacated South 5^th Place from West Harrison Avenue to West Cleveland Avenue, being portion of tax key number 498-0804-110 by Darling Freight, Inc.; and

Whereas, On January 20, 1995 the City of Milwaukee was granted sewer easement SE-2590 located in vacated South 5^th Place from West Harrison Avenue to West Cleveland Avenue, being portion of tax key number 498-0807-211 by Thomas A. Lorino and Ann E. Lorino; and

Whereas, On February 23, 2006, LH United, LLC requested the conveyance of the sewers and the release of the easements in said vacated South 5^th Place from West Harrison Avenue to West Cleveland Avenue for the development of the property; and

Whereas, The sewers and easements only serve LH United, LLC and do not provide a public benefit and should be released; and

Whereas, The property is to be developed into Milwaukee Soccer Complex; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper city officers are hereby authorized and directed to execute sewer easement releases SER-1541A, SER-1541B, SER-2590 and a conveyance document QCD-2770, copies of which are attached to the Common Council resolution file number 060045 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That after said easement releases have been executed by the proper city officers they shall be forwarded to the Office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
