Title

A substitute ordinance relating to the reporting of policies issued by the chiefs of the police and fire departments.

Analysis

This ordinance directs the chiefs of the police department and fire department to submit a report of any new policies issued by the respective chiefs to the common council and to the fire and police commission. This ordinance further provides that the fire and police commission shall provide an analysis of any new policy issued by the chief of police or fire chief.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 312-03-5 of the code is created to read: 

 

312-03. Duties of the Chief of Police.

5. REPORTING. The chief of police shall submit to the common council and to the fire and police commission a report of any new policy relating to the control and management of the department within 30 days of issuing the policy. A new policy includes a modification of an existing policy. The chief of police shall further provide a written communication to the mayor and the common council, not less than annually, summarizing the new policies issued since the last report.

 

Part 2. Section 313-02 of the code is created to read:

 

313-02. Reporting Duties of the Fire Chief. The fire chief shall submit to the common council and to the fire and police commission a report of any new policy relating to the control and management of the department within 30 days of issuing the policy. A new policy includes a modification of an existing policy. The fire chief shall further provide a written communication to the mayor and the common council, not less than annually, summarizing the new policies issued since the last report.

 

Part 3. Section 314-3-1 of the code is amended to read:

 

314-3. Duties. 

1. Conduct a policy review of all aspects of the operations of the police and fire departments, [[may prescribe general policies and standards for the departments,]] >>advise the common council regarding any recommended policy changes,<< and may inspect any property of the departments, including but not limited to books and records, required for such review.

 

Part 4. Section 314-5-4 of the code is created to read:

 

314-5. Executive Director.

4. Provide to the common council a report of any new policy relating to the control and management of each department issued by the fire chief or the chief of police within 60 days of the date of issuance of the policy. A new policy includes a modification of an existing policy. The report shall include any changes to the policy recommended by the board of fire and police commissioners. The executive director shall further provide a written communication to the mayor and the common council, not less than annually, summarizing the new policies of the fire and police departments that have been issued since the last written communication. The written communication shall contain a summary of each new policy, the date that the common council was informed, any action taken by the common council, and any changes to the policy recommended by the board of fire and police commissioners.
