Title

Resolution expressing the City of Milwaukee’s support for the George Floyd Justice in Policing Act of 2020 and directing the Department of Administration Intergovernmental Relations Division to lobby for this legislation.

Analysis

This resolution expresses the City’s support for U.S. House Resolution 7120, the George Floyd Justice in Policing Act of 2020. It further directs the Department of Administration-Intergovernmental Relations Division to lobby for this legislation.

Body

Whereas, The 2020 murder of George Floyd and subsequent protests for racial justice have illustrated the need for police reform; and

 

Whereas, The conviction of former-officer Derek Chauvin is only the first step towards greater police accountability; and

 

Whereas, The George Floyd Justice in Policing Act of 2020, introduced by Representative Karen Bass, addresses many of the most important racial-equity issues facing law enforcement today including:

 

1. Lowering the criminal intent standard to convict a law enforcement officer for misconduct from willful to knowing or reckless in a federal prosecution.

 

2. Limiting qualified immunity as a defense to liability in a private civil action against a law enforcement officer.

 

3. Granting administrative subpoena power to the Department of Justice in pattern-or-practice investigations.

 

4. Establishing a framework to prevent and remedy racial profiling by law enforcement at the federal, state and local levels.

 

5. Limiting the unnecessary use of force and restricts the use of no-knock warrants, chokeholds and carotid holds.

 

6. Creating a National Police Misconduct Registry to compile data on complaints and records of police misconduct.

 

7. Establishing new reporting requirements, including on the use of force, officer misconduct, and routine policing practices.

 

8. Directing the Department of Justice to create uniform accreditation standards for law enforcement agencies and requires law enforcement officers to complete training on racial profiling, implicit bias, and the duty to intervene when another officer uses excessive force.

 

; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee supports passage of U.S. House Resolution 7120, George Floyd Justice in Policing Act of 2020; and, be it

 

Further Resolved, That the Department of Administration - Intergovernmental Relations Division is directed to lobby the U.S. Congress to enact this legislation; and, be it

 

Further Resolved, That the City Clerk shall forward copies of this resolution to members of the City of Milwaukee’s delegation to the U.S. Senate and House of Representatives.
