Minutes note: The question was put: Have the members of the Common Council read the Report and Recommendations of the Licenses Committee and the exceptions filed in this matter? All members present indicated they had done so. The question was put: Is Chon Sung Lee or his counsel present and, if so, does either wish to address the Council? Mr. Lee was present in person with his translator. Ald. Bohl moved that the Common Council resolve itself into a committee of the whole for the purpose of hearing testimony in this matter. There was no objection. Mr. Lee appeared and addressed the Common Council. Asst. City Attorney Bruce Schrimpf appeared and addressed the Common Council. Ald. Bohl moved that the Committee of the Whole rise. There was no objection. Ald Donovan moved to reduce the 45-day suspension to 20.

Minutes note: Individuals appearing: Chon Sung Lee, Licensee Atty. Wansoo Park, counsel for the Licensee Capt. Donald Castiglione, District 2 Jarely Ruiz, City Attorney's Office Ald. Coggs at the table at 9:07 a.m. Ofc. Jeffrey Thiele, District 2. Ofc. Thiele says that is was discovered not only that the establishment was taking in jewelry in violation of the city code, but that it was also melting down jewelry before the 15-day waiting period that was established in the code had been completed. Mr. Lee said that he accepted a piece of jewelry without documentation because he felt sorry for the seller after the seller, an undercover police officer, said that he needed money. Ofc. Christopher Greer, District 2. He says that he assisted the investigating officers as an undercover officer by selling jewelry items to the establishment. Ofc. Greer says that he did not provide identification and did not complete all of the paperwork required by law when selling jewelry. Ald. Bohl said that since the video of the undercover transaction was not served on the applicant before the committee meeting, it should not be submitted as evidence. Ald. Kovac moves that the video evidence of the illegal transaction be viewed at committee. Prevailed 4-1. (Ald. Bohl voting "no") Ald. Kovac moves to make the copy of the video of the illegal transaction between Ofc. Greer and the employees of the store part of the permanent record. Prevailed 4-1. (Ald. Bohl voting "no") (Exhibit 1) Jason Cleereman, 1028 W. Washington St., is in support of the revocation. Ald. Zielinski moves to make the notice to the licensee, the police complaint, the license application and the police report part of the official record. Prevailed 5-0. Ald. Hamilton moves for a 45-day suspension based on police testimony and the police report. Prevailed 5-0.

Whereas, The Licenses Committee received a notarized complaint from the Chief of Police of the Milwaukee Police Department requesting the revocation of the Precious Metal and Gem Dealer license for the premises at 1119 W. Historic Mitchell Street ("John's Jewelry") in the 12th aldermanic district; and
 
Whereas, The Licenses Committee held an evidentiary hearing on January 19, 2010; and
 
Whereas, After considering the complaint, police testimony, and the police report, the Committee found that enough evidence existed to justify a 45-day suspension of the Precious Metal and Gem Dealer license; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Precious Metal and Gem Dealer license for the premises at 1119 W. Historic Mitchell Street ("John's Jewelry") be suspended for 45 days.
