He says that the application should have been on the consent agenda. Ald. Coggs says that since the building is being rebuilt and does not currently exist, there are questions as to whether the application should be a renewal. Atty. Schrimpf says that under Wisconsin Statutes 125.12-2-D, anyone in the community that is affected by a license has a right to come and appear before the committee even if they have not filed written objections. He also says that is the footprint of the building has changed, then the portion of the building that did not previously exist is considered a new license, not a renewal. Ald. Coggs says that she generally schedules applications if she receives complaints from neighbors so they can have an opportunity to express objections. Ald. Bohl says that the notice should only refer to excessive loitering since the complaint that was sent to Ald. Coggs only mentions excessive loitering. Even though the notice mentions other objections, they cannot be considered. Atty. Schrimpf says that his interpretation is that if the alderman of the district has knowledge that a license is causing particular issues in the neighborhood, even if those issues are not referenced in a written objection, these issues can be included on a notice. Ald. Bohl requests a formal opinion from the city attorney's office on the issue. Ald. Zielinski, based on the advice of the city attorney, moves to reject the claim by counsel the notice to the applicant was too broadly worded. Prevailed 4-1. (Ald. Bohl voting "no") Ald.
