Minutes note: 06 KAUR, Charnjit, Class “A” Liquor & Malt renewal application for “Stark Food Market” at 1301 W. Atkinson Avenue. (Expires 2-26-10) Special Letter Applicant at the table, 1301 W. Atkinson Ave. Atty. Michael Maistelman also at table as counsel. Atty. Maistelman says that he does not believe that the application should have been on the meeting agenda because there was no written objection to the license in the file and there is no police report. He says that the application should have been on the consent agenda. Ald. Coggs says that since the building is being rebuilt and does not currently exist, there are questions as to whether the application should be a renewal. Atty. Schrimpf says that under Wisconsin Statutes 125.12-2-D, anyone in the community that is affected by a license has a right to come and appear before the committee even if they have not filed written objections. He also says that is the footprint of the building has changed, then the portion of the building that did not previously exist is considered a new license, not a renewal. Ald. Coggs says that she generally schedules applications if she receives complaints from neighbors so they can have an opportunity to express objections. Ald. Bohl says that the notice should only refer to excessive loitering since the complaint that was sent to Ald. Coggs only mentions excessive loitering. Even though the notice mentions other objections, they cannot be considered. Atty. Schrimpf says that his interpretation is that if the alderman of the district has knowledge that a license is causing particular issues in the neighborhood, even if those issues are not referenced in a written objection, these issues can be included on a notice. Ald. Bohl requests a formal opinion from the city attorney's office on the issue. Ald. Zielinski, based on the advice of the city attorney, moves to reject the claim by counsel the notice to the applicant was too broadly worded. Prevailed 4-1. (Ald. Bohl voting "no") Ald. Bohl rejects the complaint by counsel that the 45-day rule was violated due to a written complaint not being in the file. Meeting recessed at 9:11 a.m. Meeting reconvened at 9:18 a.m. Atty. Maistelman says that the expansion of the building will not have any alcohol in it. Atty. Schrimpf says that the law requires that an application notify the city of any changes, including any alteration to the premises, to the license within ten days. He also says that the Department of City Development has to approve the changes to building. There was no notice to the applicant that the alteration to the premises would be discussed because the applicant neglected to notify the city of any changes to the floor plan of the establishment. Atty. Schrimpf says that the only way to proceed is to hold the application until the building plan is examined by the city. Ms. Grill says that any changes would be an extension of premises if it is in the same footprint as the currently license, not a new license. Neighborhood objectors present: Millicent Wright, 3949 N. 13th St., is opposed to the license. Ald. Bohl moves that the testimony be stricken from the record because they do not fall under the subjects included on the notice to the applicant. The motion was not voted on. Ald. Coggs says that she believes that the testimony describes conduct that is detrimental to the health, safety and welfare of the neighborhood. She also says that the item should be held until written plans are submitted to the License Division so it can be determined whether the application is new or a renewal. Ald. Coggs moves to hold to the call of the chair. Prevailed 5-0.

Wade says that there is a large amount of debris on the corner and that he has seen people loitering at the location. Deny by Ald. Hamilton based on the police report and neighborhood objections.
