Title
Resolution approving a Permanent Access and Infrastructure Easement with the Milwaukee Metropolitan Sewerage District for a portion of the City-owned property at 1923-25 South Kinnickinnic Avenue, in the 12th Aldermanic District.
Analysis
This resolution authorizes the City of Milwaukee to convey to the Milwaukee Metropolitan Sewerage District easement interests in and to a portion of the City-owned parcel at 1923-25 South Kinnickinnic Avenue for access and infrastructure.
Body
Whereas, The Milwaukee Metropolitan Sewerage District (“MMSD”) has a Metropolitan Interceptor Sewer line (“Facilities”) that runs under a portion of 1923-25 South Kinnickinnic Avenue (“Property”); and
Whereas, MMSD needs a Permanent Access & Infrastructure Easement (“Easement”) to operate and maintain their Facilities on the Property; and
Whereas, Land needed for the Easement is owned by the City of Milwaukee (“City”) and was acquired by Award of Damages on December 17, 2003 as part of the Chase Avenue Bike Trail; and
Whereas, The proposed Easement has been submitted to this file; and
Whereas, MMSD will pay no compensation for the Easement; and
Whereas, The Department of City Development (“DCD”) and Department of Public Works reviewed the proposed documents in consultation with the City Attorney’s Office; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of DCD, or designee, is authorized to execute the Easement and other documents necessary to grant the Easement to MMSD and to take such further acts as are or may be necessary to effectuate this resolution.
