Title

Resolution relating to the City of Milwaukee's proposal to cross the tracks of the Union Pacific Railroad and municipality at-grade with East Greenfield Avenue, a public street and existing crossing.

Analysis

This resolution authorizes the City of Milwaukee to cross the tracks of the Union Pacific Railroad and municipality at-grade with East Greenfield Avenue, a public street and existing crossing.

Body

Whereas, The City of Milwaukee (“City”) proposes to cross the tracks of the Union Pacific Railroad and municipality at-grade with East Greenfield Avenue, a public street and existing crossing 177164G; and

 

Whereas, The modified crossing is necessary to promote public safety and convenience for the operation of Komatsu Ltd.; and

 

Whereas, The modification of crossing 177164G is advisable under all the circumstances; and

 

Whereas, Section 195.29 Wisconsin Statutes authorizes the Office of the Commissioner of Railroads to determine whether the establishment of the crossing is necessary to promote public safety and convenience and is advisable, to determine the necessary warning devices for the modified crossing, and to apportion all costs for the modified crossing, including the costs of any automatic warning devices; and

 

Whereas, The Industry, Komatsu Ltd., proposes to pay all costs associated with signal relocation; now, therefore, be it

 

Resolved, That the Common Council of the City of Milwaukee hereby directs City staff to take all necessary steps to petition the Office of the Commissioner of Railroads for an investigation and order to approve the establishment of the new crossing, to determine the necessary warning devices, and to apportion the costs for the modified crossing of East Greenfield Avenue with the tracks of the Union Pacific Railroad and municipality in the City of Milwaukee, Milwaukee County, Wisconsin; now, therefore, be it

 

Further resolved, That City staff shall comply with Chapter 195, Wisconsin Statutes and RR 1.025, Wisconsin Administrative Code in the filing of the petition.
