Analysis

This resolution authorizes settlement of claims raised by the claimant, Michelle Kinnard, in the two ERD charges entitled Michelle Kinnard v. City of Milwaukee, ERD Case No. CR201802412, cross-filed with EEOC Case No. 443-2018-01795; and ERD Case No. CR201902717, cross-filed with EEOC Case No. 443-2019-02541, for the total amount of $11,500.00.

Whereas, Claimant Michelle Kinnard filed an ERD charge against the City of Milwaukee, ERD Case No. CR201802412, cross-filed with EEOC Case No. 443-2018-01795; and ERD Case No. CR201902717, cross-filed with EEOC Case No. 443-2019-02541; and

Whereas, Michelle Kinnard and the City of Milwaukee have entered into an agreement to settle the claims raised by her in the above-referenced matters for the total amount of $11,500.00; and

Whereas, the City Attorney recommends that the City of Milwaukee settle these matter; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue the following City checks totaling $11,500.00 payable as follows: $1,000.00  made out to “Michelle A. Kinnard” and $10,500.00 made out to “Hynes & Kuhn, S.C.” as soon as practicable, in full and final settlement of these ERD cases and the cross-filed EEOC cases, said checks to be delivered to the City Attorney upon his request, to be charged to the Damages and Claims Fund, Account No. 636505, Fund No. 0001, Organization No. 1490, Program No. 2632, Sub Class No. S118; and be it

Further Resolved, That for and in consideration of the above-referenced payment, Ms. Kinnard will provide to the City a release as approved by the City Attorney of any and all claims arising out of or in any way related to the subject incidents.
