He added that there was a shooting and he found the casings in his backyard. He added that he has found needles in his property, his backdoor was kicked in, and there are constant fights. He added that his house vibrates from the loud music at the premises. The applicant provided photos of needles, smashed windows, graffiti, smashed cars, empty beer bottles, trash, and tire skid marks. Stacy Mabele 1129 N Marshall St stated he used to live near the premises and drunken patrons used to knock on his door. He added that when he opened the door he was assaulted, and people were constantly fighting in front of his home. He stated he moved because of the constant problems on Friday and Saturday nights. He added that there were constantly beers in his mailbox. He stated that security cannot control the crowds. Ald. Lewis moved to enter in to the record as exhibit #1 the photos from Mr. Hamilton. The applicant stated when there is an altercation at the premises they make the parties leave, but not at the same time. He added that on Fridays and Saturdays the do last call early and the patio closes at 1:45 AM. He added that there is a security person dedicated to the patio and the will build a higher fence. Appearing with the applicant: Atty. Kendrick Yandell stated the premises has been open for a year and half and doesn't have a lot of problems. He added that the applicant has been cooperative and responsive with the police. He provided photos to show the fence, cameras, and lighting that have been installed. He added that the applicant has hired professional armed security. He stated that several of the items on the police report resulted from the premises calling the police for assistance. He stated that #10 on the police report was shots fired from the Scrub-a-Dub parking lot. He added that there are regular patrols of the lot and anyone parking in the lot must provide ID to be scanned with an ID scanner to track people down if there are problems. He stated that #14 in the police report has been rectified by the applicant giving the neighbors his cell phone number if there are cars blocking the alley. He added that #7 in the police report involved a UFC fighter from Chicago who just wanted to start a fight in a bar, and he doesn't believe the victim was actually jumped and robbed. He stated that #16 in the police report where the applicant was unaware that a fight had occurred because it was near bar time, and later that same evening 2 man broke in to the premises, which is #17 on the police report. He added that the applicant showed MPD the surveillance video and MPD determined the person in the hospital was in the video causing damage to the property. He added that #13 on the police report involved 2 moms who had previous problems with each other, and the woman with the laceration declined medical attention. He stated that if the patio is closed earlier it will create a problem of patrons being out in front of the premises. He stated that while there are a lot of incidents on the police report, they were all addressed by the applicant. He added that a suspension isn't warranted because the applicant is improving the business and has a good relationship with the neighbors. Ald. Lewis moved to enter the photos in to the record as exhibit #1. (Prevailed 3-0) Individuals also present: Gloria Tamalo 1568 S. 2nd St. stated she is concerned about the very loud music, but it's not often. Ald. Perez stated he is concerned that there were 2 incidents were police were dispatched to St. Luke's rather than being notified by the premises. He stated that he doesn't think a higher fence will work and he recommends the patio be closed at 10 PM Sunday-Thursday and 11 PM Friday and Saturday. He recommends the capacity being lowered to 80 to control the patrons and a 25+ age restriction. He added that with a lower capacity the patio can close at 1 AM. He recommends at 10 day suspension in addition to the changes. Ald. Coggs moved to amend the plan of operation to close the patio at 1 AM. (Prevailed 4-0) Ald.
