Analysis

This resolution authorizes the proper City officers to execute a Quit Claim Deed (QCD-2882) and Sewer Agreement (SE-2882) document conveying the sanitary sewer from a point 402’+/- west of South 6^th Street in West Canal Street to a point 374’ +/- south of West Canal Street to Lone Star Industries, in the 12^th Aldermanic District. The sewer is being conveyed because it is no longer needed for public use.

Body

Whereas, In 1938, the City of Milwaukee constructed an 18-inch diameter sanitary sewer from a point 402’ west of South 6^th Street in West Canal Street to a point 374’  south of West Canal Street; and

Whereas, The land is now owned by Lone Star Industries; and

Whereas, The said sewer no longer serves the public interest; and

Whereas, Lone Star Industries has agreed to accept ownership of said sewer, remove the existing sanitary manhole, construct a new sanitary manhole, and extend the sanitary sewer from the proposed manhole to the existing sanitary sewer; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized to execute the Quit Claim Deed document (QCD-2882) and Sewer Agreement (SE-2882), in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution) and to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
