Analysis
This resolution approves an amended Update and Amendment Procedure for Comprehensive Planning and authorizes the City Plan Commission and Department of City Development to implement these procedures when developing, updating and amending the City of Milwaukee’s Comprehensive Plan.
Body
Whereas, Section 66.1001 of the Wisconsin State Statutes requires that all cities adopt a Comprehensive Plan to guide the physical, social and economic development of the city and also requires that local governments adopt written procedures for updating the Comprehensive Plan and fostering public participation in the planning process; and
Whereas, The City Plan Commission and the Common Council of the City of Milwaukee seek to involve citizens, public agencies, community-based organizations, officials and other interested parties in the development of the Comprehensive Plan and its policies to the greatest extent possible; and
Whereas, Common Council File No. 040565, adopted on September 21, 2004, established the procedures for seeking Public Participation in the development of the City of Milwaukee’s Comprehensive Plan and for updating and amending the Comprehensive Plan after adoption; and
Whereas, The 13 Area Plans and the Citywide Policy Plan that make up the Comprehensive Plan for the City of Milwaukee were subsequently adopted by the Common Council on July 27, 2010 as required by Section 66.1001 of Wisconsin State Statutes through the approval of Common Council File No. 100247; and
Whereas, Since the adoption of the Comprehensive Plan, the Department of City Development has undertaken a series of Action Planning and other planning initiatives that have resulted in updates and amendments to the Comprehensive Plan; and
Whereas, During 2016, the State of Wisconsin enacted Act 391 establishing new requirements within Section 66.1001 of the Wisconsin State Statutes for providing notice to residents about the manner in which they may request to be notified of proposed changes to a Comprehensive Plan; and
Whereas, The City of Milwaukee wishes to amend the Update and Amendment Procedure for Comprehensive Planning to clarify the process associated with different types of Comprehensive Plan amendments and updates, comply with the new requirements of Section 66.1001 and incorporate additional measures to maximize public participation in the planning process; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Plan Commission and the Department of City Development shall implement and administer the amended Update and Amendment Procedure when updating the City of Milwaukee’s Comprehensive Plan and that this Update and Amendment procedure replaces the procedure approved with the adoption of Common Council File No. 040565.
