Resolution authorizing the proper City officials to execute a Quit Claim Deed (QCD-2865) document conveying sanitary and combined sewers located in vacated North 5th Street between West Highland Avenue and West Juneau Avenue and storm sewer located in the easterly half of the east-west leg of the vacated alley bounded by North 5th Street, West Juneau Avenue, North 4th Street and West Highland Avenue to Deer District LLC, in the 4th Aldermanic District.
Analysis
This resolution authorizes the proper City officers to execute a Quit Claim Deed (QCD-2865) document conveying the sanitary and combined sewers located in vacated North 5th Street between West Highland Avenue and West Juneau Avenue and the storm sewer located in the easterly half of the east-west leg of the vacated alley bounded by North 5th Street, West Juneau Avenue, North 4th Street and West Highland Avenue to Deer District LLC, in the 4th Aldermanic District. The sewers are being conveyed because they are no longer needed for public use.
Body
Whereas, North 5th Street between West Highland Avenue and West Juneau Avenue along with the east-west leg of the alley bounded by North 5th Street, West Juneau Avenue, North 4th Street and West Highland Avenue were vacated on March 1, 2016 by Common Council File Number 151183; and
Whereas, The City of Milwaukee owns a 12-inch diameter storm sewer in the easterly half of said vacated alley; and
Whereas, The City also owns a12-inch diameter sanitary sewer and a 15 to 21-inch diameter combined sewer in said vacated North 5th Street; and
Whereas, The vacated lands are now part of Deer District LLC; and
Whereas, Said sewers no longer serve the interest of the City; and
Whereas, The Deer District LLC has agreed to accept ownership of said sewers; now, therefore, be it
