Analysis

This resolution authorizes the proper City officers to execute a Quit Claim Deed (QCD-2865) document conveying the sanitary and combined sewers located in vacated North 5^th Street between West Highland Avenue and West Juneau Avenue and the storm sewer located in the easterly half of the east-west leg of the vacated alley bounded by North 5^th Street, West Juneau Avenue, North 4^th Street and West Highland Avenue to Deer District LLC, in the 4^th Aldermanic District. The sewers are being conveyed because they are no longer needed for public use.

Body

Whereas, North 5^th Street between West Highland Avenue and West Juneau Avenue along with the east-west leg of the alley bounded by North 5^th Street, West Juneau Avenue, North 4^th Street and West Highland Avenue were vacated on March 1, 2016 by Common Council File Number 151183; and

Whereas, The City of Milwaukee owns a 12-inch diameter storm sewer in the easterly half of said vacated alley; and

Whereas, The City also owns a12-inch diameter sanitary sewer and a 15 to 21-inch diameter combined sewer in said vacated North 5^th Street; and

Whereas, The vacated lands are now part of Deer District LLC; and 

Whereas, Said sewers no longer serve the interest of the City; and

Whereas, The Deer District LLC has agreed to accept ownership of said sewers; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials, including the DPW Commissioner, are hereby authorized: (i) to sign the Quit Claim Deed document (QCD-2865), in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
