Analysis
This ordinance establishes locations where selling articles from parked vehicles is prohibited within the 11th aldermanic district. Currently, the only location within the 11th aldermanic district where selling articles from parked vehicles is prohibited is W. Oklahoma Ave. from S. 16th St. west to city limits (Common Council File Number 58-1172-a, passed July 22, 1958).

Whereas, The public way includes streets and sidewalks that are dedicated thoroughfares intended for vehicular and pedestrian traffic; and
Whereas, Vendors selling articles from parked vehicles use the public way to conduct business operations; and
Whereas, Vending from parked vehicles attracts the congregation of people, which results in illegal parking and littering; and
Whereas, Vending from a parked vehicle may create loud noise when the operation is open for business; and
Whereas, Selling articles from parked vehicles contributes to traffic congestion and may create a public nuisance; and
Whereas, Both s. 62.11(5), Wis. Stats., and s. 4-10, Milwaukee City Charter, provide that the Common Council may enact legislation to protect the health safety and welfare of the residents of the City of Milwaukee; now, therefore
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 115-45 of the code relating to Selling Articles from Parked Vehicles, Locations Where Selling Prohibited is amended by adding the following:
The east and west sides of S. 27th St. from the Union Pacific Railroad south to W. Morgan Ave. all the days of the week, including Sundays and holidays.
The east and west sides of S. 28th St. from W. Oklahoma Ave. south to W. Euclid Ave. all the days of the week, including Sundays and holidays.
