Analysis
This resolution authorizes the City of Milwaukee to grant to the Wisconsin Electric Power Company an easement for underground electrical equipment and facilities across and at a City-owned property at 3921 West Lincoln Avenue for access and infrastructure purposes to service the Milwaukee Metropolitan Sewerage District.
Body
Whereas, The Milwaukee Metropolitan Sewerage District (“MMSD”) has a planned construction project for the 43rd Street ditch located within the ditch portion of 3921 West Lincoln Avenue (the “Property”) and this construction is requiring new facilities to be instated by We Energies; and
Whereas, To accommodate the project, Wisconsin Electric Power Company, doing business as WE Energies, has requested a Distribution Easement Underground Easement (“Easement”) at and across a portion of the Property to operate and maintain their facilities on the Property for MMSD; and
Whereas, A copy of the proposed Easement and related map have been attached to this file; and
Whereas, The Easement is for the benefit of MMSD and neither MMSD nor WE Energies will pay the City compensation or a fee for the Easement; and
Whereas, The Department of City Development (“DCD”) and Department of Public Works (“DPW”) have reviewed the proposed documents in consultation with the City Attorney’s Office; and
Whereas, DCD and DPW recommend approval of the Easement; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves the Easement between the City of Milwaukee and WE Energies for the placement of underground electrical equipment and facilities at 3921 West Lincoln Avenue, a copy of which is attached to this file; an...
