Title
Resolution authorizing the Commissioner of Public Works to execute a Maintenance Covenant document between the City of Milwaukee and Milwaukee Metropolitan Sewerage District requiring the City of Milwaukee to keep, preserve, and maintain the green infrastructure located in the area bounded by South 18th Street, West Windlake Avenue, West Harrison Avenue, South 20th Street, and West Arthur Avenue, in the 12th Aldermanic District.
Analysis
This resolution authorizes the Commissioner of Public Works to execute a Maintenance Covenant document titled Green Infrastructure Ten-Year Maintenance Covenant for Alleys near Pulaski Park. The Maintenance Covenant requires the City of Milwaukee to keep, preserve, and maintain green infrastructure in the area bounded by South 18th Street, West Windlake Avenue, West Harrison Avenue, South 20th Street, and West Arthur Avenue.

Whereas, Stormwater pollution control is an important component of the City of Milwaukee’s (City) storm water management regulations and the City’s stormwater permit with the Wisconsin Department of Natural Resources (DNR); and
Whereas, Nonpoint sources such as roadways have been recognized as the primary source of environmental pollution by discharging polluted runoff directly into the local streams and water bodies, threatening natural habitat and species; and
Whereas, In 2014, the City was awarded a Green Infrastructure Partnership Program Grant from Milwaukee Metropolitan Sewerage District (MMSD); and
Whereas, The grant funds allowed green infrastructure consisting of permeable pavement to be installed in alleys within said boundary; and
Whereas, The funding agreement for said grant stipulated that, in order for the MMSD to reimburse the City of the cost of the project, the City shall execute a maintenance covenant in favor of MMSD; and
Whereas, MMSD has drafted said covenant which shall be in effect for a period of ten year...
