Analysis

This ordinance prohibits the smoking of electronic cigarettes on city property and in those places that cigarette smoking is prohibited under state law.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 105-48-4 of the code is renumbered 105-48-5.

 

Part 2. Section 105-48-4 of the code is created to read:

 

105-48. Smoking Prohibited.

4. ELECTRONIC CIGARETTES. Prohibitions against smoking under this section shall include use of an electronic smoking device and electronic smoking device paraphernalia, as defined in 106-30.2-1.

 

Part 3. Section 105-49-4 of the code is created to read:

 

105-49. Smoking Prohibited on City Property.

4. ELECTRONIC CIGARETTES. Prohibitions against smoking on city property under this section shall include use of an electronic smoking device and electronic smoking device paraphernalia, as defined in s. 106-30.2-1.
