Analysis
This ordinance authorizes the department of neighborhood services to issue a repeat litter charge if any owner fails, omits, neglects or refuses to maintain a property which results in 3 or more violations of s. 79-12 in any 12-month period. Section 79-12 prohibits persons from depositing, permitting or causing to be deposited, any litter, solid waste or nauseous or offensive substance or material upon any premises. The $100 charge, established through creation of s. 200-33-49.2, will be issued for the third and subsequent violations and will compensate for inspectional, administrative and equipment costs.

This ordinance takes effect 30 days after passage and publication.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 79-16-2-a-2 of the code is renumbered 79-16-2-a-3.

Part 2. Section 79-16-2-a-2 of the code is created to read:
79-16. Penalty.
2.LIEN.
a-2.If any owner fails, omits, neglects or refuses to maintain a property which results in 3 or more violations of s. 79-12 in any 12-month period, the commissioner of neighborhood services may issue a repeat litter charge for the 3rd and subsequent violations to compensate for inspectional, administrative and equipment costs. The charge shall be in accordance with s. 200-33-49.2.

Part 3. Section 200-33-49.2 of the code is created to read:
200-33. Fees.
49.2.REPEAT LITTER CHARGE. To compensate for inspectional, administrative and equipment costs, the commissioner may issue a $100 charge for the 3rd and each subsequent violation of s. 79-12 on any property in a 12-month period.
