Analysis

This Resolution authorizes the City to pay Bruce Annoye $15,000 to acquire, in fee, the west 33.01 feet of part of tax key number 526-9993-100-4 for completion of South 85^th Street between W. Ohio Avenue and West Euclid Avenue.

Body

Whereas, The Common Council in Resolution File No. 040920, had authorized City condemnation against Bruce Annoye's ownership interest in the west 33.01 feet of part of tax key number 526-9993-100-4 (the "Parcel") so that South 85^th Street between W. Ohio Avenue and West Euclid Avenue could be completed; and

Whereas, Subsequent to that resolution, the City's Department of Public Works, with assistance from the City Attorney's Office, was able to negotiate with Mr. Annoye his quit-claiming the Parcel to the City, in lieu of condemnation, for $15,000; now, therefore, be it

Resolved, That the Common Council of the City of Milwaukee approves the City acquiring the Parcel from Mr. Annoye, by quit-claim deed, in lieu of condemnation, for $15,000; and, be it

Further Resolved, That the Common Council authorizes and approves appropriation from DPW Account No. ST210050102 and expenditure of $15,000 for such acquisition; and, be it

Further Resolved, That the proper City officials are authorized to execute such documents as may be necessary or required to accomplish the acquisition and the purposes of this resolution.
