CITY PLAN COMMISSION
| RECOMMENDED FOR PASSAGE AND ASSIGNED
Minutes note: Ms. Fonseca introduced the file.
This ordinance requires the board of zoning appeals to notify the local common council member and the department of neighborhood services within 15 days whenever a zoning appeal expires.
Appearing:
India Gaar, BOZA Administrative Manager
Pres. Jose Perez, 12th Ald. Dist.
Ald. DiAndre Jackson, 7th Ald. Dist.
Ms. Gaar said that her office will work with ITMD to be able to extract a report to notice accordingly and had no objections.
Pres. Perez and Ald. Jackson testified in support. The proposed ordinance would help address public safety relating to uses operating beyond their approval term and there being no entity verifying compliance with the use’s conditions of approval. The legislation would require BOZA to notify both the alderperson, in which the use is located, and DNS of an expired special use or variance approval. The legislation would be a measure to quickly, within 15 days, alert DNS of a zoning violation, without placing an undue burden or unfunded mandate on BOZA. DNS would then seek compliance for the zoning violation upon receiving the notice.
There was inquiry and discussion on the current notification and inspection processes.
Commissioner Crane moved approval, seconded by Commissioner Washington. (Prevailed 6-0)
