Title
Substitute motion modifying Milwaukee Police Department Standard Operating Procedure 460 - Use of Force.
Analysis
This motion modifies Milwaukee Police Department Standard Operating Procedure 460 - Use of Force. This modification restores a recently deleted requirement that a Use of Force Report be written when a department member draws or displays a firearm to effect an arrest or seizure of a person. It also restores a provision that exempted this type of Use of Force Report from the requirement that photographs to illustrate any injury or lack thereof be taken of the subject against whom force was used.
Body
Whereas, The settlement of claims in the lawsuit entitled Sterling D. Brown v. City of Milwaukee, et al., Case No. 18-CV-922-PP, required that Milwaukee Police Department Standard Operating Procedure 460 - Use of Force be amended to require the completion of a Use of Force Report when a department member draws or displays a firearm (including a shotgun or rifle) to effect an arrest or seizure of a person; and
Whereas, The obligations pursuant to the settlement agreement were time-limited and are no longer applicable; and
Whereas, Effective October 16, 2024, Milwaukee Police Department General Order 2024-47 made changes to Standard Operating Procedure 460 - Use of Force, including ending the requirement, previously documented in section 460.50.B.1.j, that a Use of Force Report be completed when a department member draws or displays a firearm (including a shotgun or rifle) to effect an arrest or seizure of a person; and
Whereas, S. 62.50(3)(am), Wis. Stats., allows the Common Council to suspend or modify any policy established by the Chief of Police upon a two-thirds vote of all of the members of the Common Council; now, therefore
