Analysis
This resolution authorizes and directs the proper City officers to execute a Quit Claim Deed (QCD-2772) document conveying the combined sewer located in RIVERBEND PLACE, LLC property in the limits of vacated North Commerce Street between vacated West Vliet Street and West Cherry Street. The sewer is being conveyed to allow the construction of the new Manpower/Riverbend Development Facility and parking areas (IMPROVEMENTS).
Body
Whereas, North Commerce Street between West Cherry Street and North Martin Luther King, Jr. Drive was vacated on February 2, 2000 by Resolution Number 990739; and

Whereas, The vacation of North Commerce Street resulted in the need to retain the combined sewer in the vacated portion and obtain a sewer easement; and

Whereas, There is an existing 482 +/- feet of a 15-inch diameter combined sewer and 44 +/- feet of an 18-inch diameter combined sewer in vacated North Commerce Street between the easterly extension of the southerly line of vacated West Vliet Street and the easterly extension of the southerly line of West Cherry Street; and

Whereas, Circumstances changed when some of the properties were consolidated under Riverbend Place, LLC, who is going to construct the improvements at the said location; and

Whereas, With some properties consolidated under one ownership, a portion of the combined sewer serves only one property and can, therefore, be conveyed to the owner; and

Whereas, Riverbend Place, LLC has agreed to accept ownership of said portion of combined sewer; and

Whereas, The conveyed combined sewer will be abandoned by Riverbend Place, LLC because the improvements will be constructed over said sewer, hence, it is not required...
