Analysis

This resolution accepts a Release of Easement and authorizes the proper City officials, including the Commissioner of Public Works, to execute the document.

Body

Whereas, On June 18, 1945, the City of Milwaukee was granted an Easement that was recorded in the Milwaukee County Register of Deeds Office as Document No. 2574140 on August 1, 1945, for access and maintenance of a water gate valve, located in West Michigan Street on the west line of North 39^th Street by Marquette University (the “Easement”); and

Whereas, the current property owner, Meta House I, LLC, desires to develop the lands within the Easement area; and

Whereas, there are no active public water facilities within the Easement area of Easement No. 2574140; and

Whereas, the Easement is no longer required for current or future public water purposes and does not serve the interest of the City of Milwaukee and should be released; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee, that Release of Easement, a copy of which has been made part of this file, is hereby approved and the proper City officials, including the Commissioner of Public Works, are hereby authorized to execute same on City’s behalf and to cause same to be recorded in the Milwaukee County Register of Deeds Office.
