A substitute ordinance relating to notices regarding public hearings conducted for certain license applications.

Analysis

This ordinance establishes the following:

1.  Upon request by the local council member, the city clerk may provide, by mail, written notice, regarding an application for any of certain specified licenses which are scheduled for a hearing before the licensing committee of the common council, to up to 100 single-family residences in the immediate area of the property for which a license is sought, or to each resident of the circular area having a radius of 250 feet, centered on the property for which a license is sought, whichever is greater.

2.  Regardless of their residence, those interested parties who have made written requests to the city clerk to be notified of a hearing for a particular license application shall be provided notice by the city clerk.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1.  Section 84-6 of the code is created to read:

84-6.                     Notice of Hearing.

1.  CITY CLERK TO NOTIFY.  Upon request of the local council member, the city clerk may provide, by mail, written notice, regarding an application for any of the following licenses, which are scheduled for a hearing before the licensing committee of the common council, to up to100 single-family residences in the immediate area of the property for which a license is sought, or to each resident of the circular area having a radius of 250 feet, centered on the property for which a license is sought, whichever is greater:

a.  Auto wrecker.

b.  Center for the visual and performing arts.

c.  Class “A” liquor.

d.  Class “A” liquor and malt.

e.  Class “A” malt.

f.   Class “B” tavern.

g.  Class “B” fermented malt beverage.

h.  Class “C” wine.

i.   Dance hall.

j.   Extended hours establishment.

k.  Hotel and motel.

l.   Instrumental music.

m. Secondhand motor vehicle.

n.  Shows and exhibitions.

o.  Rooming house.

p.  Tavern dance and music.

q.  Tavern amusement.

r.   Temporary extension of Class “B” tavern premises.

s.  Used bicycle, tire or battery dealer.

 

2.  EXCEPTION.  Notwithstanding sub. 1, those interested parties who have made written requests to the city clerk to be notified of a hearing for a particular license application shall be provided notice by the city clerk regardless of their residence
