Title

Resolution declaring a vacant lot at 2701 South 70th Street surplus to municipal needs and authorizing its sale to Michael J. Berns, the adjoining owner, for use as green space, in the 11th Aldermanic District.

Analysis

This resolution declares a City-owned vacant lot surplus to municipal needs and permits the City of Milwaukee to accept an Offer to Purchase pursuant to Section 304-49-17, Milwaukee Code of Ordinances.

Body

Whereas, Michael J. Berns, the owner of the duplex at 2707-09 South 70th Street, has offered to purchase the adjoining, unbuildable City-owned vacant lot at 2701 South 70th Street for $3,375; and

 

Whereas, Michael J. Berns has agreed to use the lot as green space and to combine it with his adjacent property to create a single property that cannot be developed or divided without the approval of the Common Council; and

 

Whereas, Section 304-49-17, Milwaukee Code of Ordinances, allows the City of Milwaukee (“City”) to accept offers to purchase and convey property to a designated entity for adequate fair market consideration; and

 

Whereas, The Department of City Development (“DCD”) has reviewed the offering price and believes the price represents fair market value of the lot in its “as is, where is” condition and recommends acceptance of the Offer; and

 

Whereas, The City Plan Commission has determined that the lot is surplus to municipal needs; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the vacant lot at 2701 South 70th Street is declared surplus and that the Commissioner of DCD, or designee, is authorized to accept the Offer to Purchase and to close the sale; and, be it

 

Further Resolved, That the sale proceeds, less sale expenses and a 20 percent disposition cost reimbursement to the Redevelopment Authority of the City of Milwaukee, shall be deposited into the Reserve For Tax Deficit Fund Account No. 0001-334106.
