Title

Resolution approving the sale of the City-owned library property at 1432 West Forest Home Avenue, in the 12th Aldermanic District.

Analysis

This resolution authorizes the sale of City-owned library property according to the conditions in a Land Disposition Report pursuant to Section 304-49, Milwaukee Code of Ordinances.

Body

Whereas, The Milwaukee Public Library Board of Trustees (“MPL”) voted to surplus the former Forest Home Branch Library, located at 1432 West Forest Home Avenue (“Property”), at its meeting on September 26, 2017 and authorized the City of Milwaukee (“City”) to offer the Property for sale as of November 1, 2017; and

 

Whereas, The Department of City Development (“DCD”) advertised the Property for sale by Request for Proposals until August 30, 2018 and received one proposal from Voces De La Frontera, Inc. (“Voces”); and

 

Whereas, The City Plan Commission (“CPC”) makes recommendations to the Common Council of the City of Milwaukee (“Common Council”) regarding the sale of land used for public facilities, and CPC recommended sale, which the Common Council approved by Resolution File No. 180907; and

 

Whereas, The Voces transaction failed to materialize; and

 

Whereas, DCD relisted the Property for sale on March 29, 2019 and received one proposal from HK Gill Properties, LLC but the sale file did not proceed to Common Council because the buyer transaction failed to materialize; and

 

Whereas, City again relisted the Property for sale on November 4, 2019 and received two proposals that were evaluated by DCD; and

 

Whereas, MPL on September 22, 2020 approved the sale to I-Forest LLC (“Buyer”) upon the terms and conditions contained in the Land Disposition Report (“LDR”) that was made part of this file; and

 

Whereas, A copy of the LDR was provided to CPC, and CPC met on November 9, 2020 and CPC recommended approval of the sale; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the LDR and Due Diligence Checklist that have been submitted to this file are approved and City representatives, including the DCD Commissioner or designee, are authorized to enter into a Purchase and Sale Agreement (“PASA”) with the Buyer, materially consistent with the LDR, and to close on that transaction and convey the Property to the Buyer in accordance therewith, and to take such further steps as may be necessary to effectuate this Resolution; and, be it

 

Further Resolved, That the net sale proceeds, less sale and closing expenses and a 5 percent disposition fee to the Redevelopment Authority of the City of Milwaukee, shall be credited to the appropriate Library Fund as per Wis. Stat. 43.58.
