Analysis

This ordinance allows each department head to designate special deputy powers to the second-in-command.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 50-37 of the code is created to read:

 

50-37. Special Deputy. The port director may designate as a special deputy port director a competent person within his or her office to act for and in his or her stead in specified matters without additional compensation. Such an appointment shall be in writing and copies filed in the city clerk’s office setting forth the specific acts the special deputy is authorized to perform in the name of the port director. Such authority may be revoked and amended in the same manner. Within the scope of his or her specified authority, the special deputy may perform any and all acts required of the port director. The port director shall be responsible for all acts of any special deputy. The special deputy shall, before entering upon his or her duties, take the oath required of city officers.

 

Part 2. Section 200-01-4 of the code is created to read:

 

200-01. Department of Neighborhood Services

4. SPECIAL DEPUTY. The commissioner may designate as a special deputy commissioner a competent person within his or her office to act for and in his or her stead in specified matters without additional compensation. Such an appointment shall be in writing and copies filed in the city clerk’s office setting forth the specific acts the special deputy is authorized to perform in the name of the commissioner. Such authority may be revoked and amended in the same manner. Within the scope of his or her specified authority, the special deputy may perform any and all acts required of the commissioner. The commissioner shall be responsible for all acts of any special deputy. The special deputy shall, before entering upon his or her duties, take the oath required of city officers.

 

 

 

 

Part 3. Section 307-1.5 of the code is created to read:

 

307-1.5. Special Deputy. The commissioner of assessments may designate as a special deputy commissioner of assessments a competent person within his or her office to act for and in his or her stead in specified matters without additional compensation. Such an appointment shall be in writing and copies filed in the city clerk’s office setting forth the specific acts the special deputy is authorized to perform in the name of the commissioner of assessments. Such authority may be revoked and amended in the same manner. Within the scope of his or her specified authority, the special deputy may perform any and all acts required of the commissioner of assessments. The commissioner of assessments shall be responsible for all acts of any special deputy. The special deputy shall, before entering upon his or her duties, take the oath required of city officers.

 

 

Part 4. Section 310-2.5 of the code is created to read:

 

310-2.5. Special Deputy. The director of administration may designate as a special deputy director of administration a competent person within his or her office to act for and in his or her stead in specified matters without additional compensation. Such an appointment shall be in writing and copies filed in the city clerk’s office setting forth the specific acts the special deputy is authorized to perform in the name of the director of administration. Such authority may be revoked and amended in the same manner. Within the scope of his or her specified authority, the special deputy may perform any and all acts required of the director of administration. The director of administration shall be responsible for all acts of any special deputy. The special deputy shall, before entering upon his or her duties, take the oath required of city officers.

 

 

Part 5. Section 314-6 of the code is created to read:

 

314-6. Special Deputy. The executive director may designate as a special deputy executive director a competent person within his or her office to act for and in his or her stead in specified matters without additional compensation. Such an appointment shall be in writing and copies filed in the city clerk’s office setting forth the specific acts the special deputy is authorized to perform in the name of the executive director. Such authority may be revoked and amended in the same manner. Within the scope of his or her specified authority, the special deputy may perform any and all acts required of the executive director. The executive director shall be responsible for all acts of any special deputy.  The special deputy shall, before entering upon his or her duties, take the oath required of city officers.

 

 

Part 6. Section 390-8 of the code is created to read:

 

390-8. Special Deputy. The director of emergency communications may designate as a special deputy director of emergency communications a competent person within his or her office to act for and in his or her stead in specified matters without additional compensation. Such an appointment shall be in writing and copies filed in the city clerk’s office setting forth the specific acts the special deputy is authorized to perform in the name of the director of emergency communications. Such authority may be revoked and amended in the same manner. Within the scope of his or her specified authority, the special deputy may perform any and all acts required of the director of emergency communications. The director of emergency communications shall be responsible for all acts of any special deputy.  The special deputy shall, before entering upon his or her duties, take the oath required of city officers.
