Title
Resolution approving a Land Disposition Report and the RACM conveyance to the Milwaukee Metropolitan Sewerage District of 4250 North 35th Street for stormwater management purposes for the 30th Street Industrial Corridor, in the 1st Aldermanic District.
Analysis
This resolution will permit RACM to convey 4250 North 35th Street to MMSD for stormwater management purposes for the 30th Street Industrial Corridor.
Body
Whereas, As indicated in the Land Disposition Report, a copy of which is attached to this Common Council File, on December 13, 2007, by passage of Resolution No. 9970 following a public hearing, the Redevelopment Authority of the City of Milwaukee (“RACM”) approved a Redevelopment and Eminent Domain Contract with Integrated Mail Industries, Ltd. (“IMI”) in which RACM agreed to use its eminent domain powers to acquire privately owned property to facilitate IMI’s expansion needs and to retain and expand employment in the 30th Street Industrial Corridor; and
Whereas, RACM’s action also approved the blight designation and acquisition of the private properties at 3478 West Hopkins Street, 4250 North 35th Street and 4260-4300 North 35th Street from Bee Bus Lines, Inc. (“Bee Bus”) and the subsequent conveyance to IMI for expansion; and
Whereas, The Common Council of the City of Milwaukee, through adoption of File No. 071239 on January 15, 2008, confirmed the blight designation, approved the acquisition by RACM and approved the Blight Designation Summary and Land Disposition Report dated December 13, 2007; and
Whereas, The purpose of said acquisition was to advance the public good and public welfare and to reduce or eliminate blight and blighted areas, to promote redevelopment of the 30th Street Industrial Corridor, to aid in redevelopment of the subject parcels and its neighboring parcel, to assist in economic development and betterment and to promote employment and public welfare; and
Whereas, Acquisition of the property ensured that future development of the parcels was consistent with the 30th Street Industrial Corridor Economic Development Master Plan; and
Whereas, Negotiations with Bee Bus, the property owner, resulted in a $500,000 settlement in which Bee Bus would convey only the properties at 3478 West Hopkins Street and 4250 North 35th Street directly to IMI; and
Whereas, The settlement also provided that after the property acquisition from Bee Bus, in recognition of RACM’s contribution of $200,000 toward the settlement, using funds from the 30th Street Industrial Corridor Project, Spot Acquisition and Brownfield accounts, IMI would convey approximately 1.88 acres of the property at 4250 North 35th Street to RACM for possible use for stormwater detention for the 30th Street Industrial Corridor; and
Whereas, RACM, per RACM Resolution No. 10173, acquired 4250 North 35th Street in 2011 from IMI; and
Whereas, The Milwaukee Metropolitan Sewerage District (“MMSD”) recently acquired the adjacent remaining Bee Bus property for stormwater management and detention purposes and has need of the RACM property at 4250 North 35th Street; and
Whereas, MMSD offered to purchase RACM’s approximately 1.88-acre property at 4250 North 35th Street for stormwater management and detention purposes; and
Whereas, RACM conducted a public hearing on March 17, 2016 and at that hearing, RACM approved the Land Disposition Report and MMSD Offer, a copy of which is attached to this Common Council File, and conditioned on Common Council approval, RACM authorized RACM signature and acceptance of the Offer and conveyance of the property to MMSD; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Land Disposition Report is hereby approved; and, be it
Further Resolved, That the Common Council authorizes and approves RACM’s acceptance of the MMSD Offer and conveyance to MMSD, in accordance with the Offer terms as submitted to this file, or in substantial conformity thereto, and RACM is further authorized to take such further actions as may be required to effectuate the intent of this resolution and the Offer.
