Analysis

This ordinance increases the penalty for failing to comply with a written notice to store solid waste and recycling containers immediately adjacent to an alley from $10 to $25. This ordinance also increases the penalty for failing to comply with a written notice to return, after servicing, garbage and recycling carts to their proper storage location from $25 to $30. Finally, this ordinance increases the penalty for failing to comply with a written notice to keep recyclables clean and free of contaminants from $20 to $25.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 79-16-2-a-1-b and d of the code is amended to read:

79-16. Penalty.

2. LEIN.a-1-b. A person who fails to comply with s.79-5-2 shall receive a written notice to comply with respect to the alleged violation of s 79-5-2. Failure to comply following such notification shall result in a special charge of [[$10]]>>$25<<, and the second and each subsequent failure to comply within a calendar year shall result in a special charge of [[$25]]>>$60<<.

 

a-1-d. If a person is found to be in violation of the requirements of s. 79-5-5, the person shall be subject to a special charge of [[$25]]>>$30<<. A person who fails to comply with s. 79-5-5 shall receive a written notice with respect to the alleged violation of s. 79- 5-5. Failure to comply following such notification shall result in a special charge of [[$35]]>>$40<<, and the second and each subsequent failure to comply within a calendar year shall result in a special charge of [[$60]]>>$70<<.

 

Part 2. Section 79-47-1-a of the code is amended to read:

1. PENALTIES. a. A person who fails to comply with s. 79-29 shall receive a written notice with respect to the alleged violation of s.79-29. Failure to comply with s. 79-29 following such notification shall result in a special charge of [[$20]]>>$25<<, and the second and each subsequent failure to comply with s. 79-29 within a calendar year shall result in a special charge of [[$40]]>>$50<<.
