Analysis

This ordinance imposes fees on landlords and property owners when the department of neighborhood services posts an emergency order on a premise.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 200-33-43.5 of the code is amended to read:

 

200-33. Fees.

 

43.5. POSTING.

 

a. The fee for posting upon a premise any notice, order, >>emergency order,<< or placard [[pursuant to]] >>under<< ss. 200-11-6, >>200-12.5<< or 218-4, shall be $60. The posting fee shall be assessed and collected as a special tax against the real estate upon which the notice, order, >>emergency order,<< or placard was posted and shall be a lien upon said real estate.

 

b. The fee for posting a placard [[pursuant to]] >>under<< s. 200-11-6 >>, or emergency order under 200-12.5,<< upon any single family premise shall be $120.

 

c. The fee for posting a placard [[pursuant to]] >>under<< s. 200-11-6 >>, or emergency order under 200-12.5,<< upon any 2-or 3-family premise shall be $240.

 

d. The fee for posting a placard [[pursuant to]] >>under<< s. 200-11-6 >>, or emergency order under 200-12.5,<< upon any premise with 4 or more residential units shall be $360.

 

e. The fee for posting a placard [[pursuant to]] >>under<< s. 200-11-6 >>or emergency order under 200-12.5<< upon any commercial building not containing residential units shall be $180.

 

f. The >>fee for posting a<< placard [[posting fee]] >>or emergency order<< shall be assessed and collected as a special tax against the real estate upon which the placard >>or emergency order<< is posted and shall be a lien upon the real estate.

 

Part 2. Section 200-33-43.5-g of the code is created to read:

 

g. Any premise that is issued more than one emergency order within 90 days shall be charged a posting fee double the fee set forth in s. 200-33-43.5-a to e for all subsequent emergency orders issued within 90 days.
