Title

Resolution approving the execution of an Easement and Maintenance Agreement with Friends of Hank Aaron State Trail, Inc. regarding the installation and maintenance of pedestrian and bicycle path kiosks on Port Milwaukee property, in the 4th Aldermanic District.

Analysis

This resolution approves the execution of an Easement and Maintenance Agreement Friends of Hank Aaron State Trail, Inc. regarding the installation and maintenance of pedestrian and bicycle path kiosks on Port Milwaukee property, in the 4th Aldermanic District.

 

Body.

Whereas, Friends of Hank Aaron State Trail, Inc. (“Grantee”) is a non-profit organization dedicated to sustaining, promoting, and enhancing the Hank Aaron State Trail; and

 

Whereas, as part of that mission, Grantee desires to install and maintain multi-use trail information kiosks on Port Milwaukee property, marking the crossroads of the Hank Aaron State Trail and Oak Leaf Trail to, among other things, assist both pedestrians and bicyclists through wayfinding maps explaining the routes connecting each trail; and

 

Whereas, on June 8, 2023, the Board of Harbor Commissions approved the execution of an Easement and Maintenance Agreement (the “Agreement”) which grants the Grantee a non-exclusive easement on the property, which is further described in Exhibit A of the Agreement, in order to install the information kiosks on the property and obligates Grantee to maintain both the kiosks and easement area during the life of the easement; and

 

Whereas, Pursuant to Wis. Stat. § 30.38(4), title to harbor lands and facilities shall vest in the municipality, which requires any encumbrance on title to be approved by the City; and

 

Whereas, The Office of the City Attorney has reviewed the proposed Easement and Maintenance Agreement, a copy of which is attached hereto; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Easement and Maintenance Agreement is hereby approved, and the proper City officials, including the Port Director, are hereby authorized to execute the Easement and Maintenance Agreement and take other reasonable steps needed to execute the Easement and Maintenance Agreement.
