Resolution approving and authorizing the execution of License Agreements and Easements necessary to permit minor encroachments in Westlawn Gardens

Body
WHEREAS, Westlawn Gardens is generally situated to the south of West Silver Spring Drive between North 60th Street and North 68th Street and the Housing Authority of the City of Milwaukee (HACM) is currently proceeding with redevelopment of Westlawn Gardens in cooperation with Westlawn Renaissance LLC Westlawn Renaissance III through VII LLCs (collectively “WR”), WG Scattered Sites LLC (“SS”) and Victory Manor LLC (“VM”); and
WHEREAS, as construction of the various phases of the Westlawn Gardens development is completed and as final as-built surveys are prepared, minor encroachments, such as walkways and parking areas, are identified on various parcels; and
WHEREAS, HACM, WR, SS and VM, as the owners of all of Westlawn Gardens, desire to enter into one or more License Agreements or Easement Agreements in order to expressly permit such minor encroachments to remain in place; and
WHEREAS, pursuant to this Resolution the Commissioners of HACM desire to approve and authorize execution of one or more License Agreements or Easement Agreements by the Secretary - Executive Director on behalf of HACM, WR, SS and VM, from time to time, in order to expressly permit minor encroachments which do not adversely impact parcels in Westlawn Gardens.
NOW, THEREFORE, BE IT RESOLVED, by the Housing Authority of the City of Milwaukee that the execution and delivery of such License Agreements and Easement Agreements is hereby approved and the proper officers of HACM are hereby authorized and directed to execute and deliver such Agreements in such form and substance as may be approved by the Secretary-Executive Director; and be it
FURTHER RESOLVED, that the Secretary-Executive Director is hereby authorized and directed to execute and deliver such Agreements on behalf of WR, SS and VM in such form and substance as may be approved by the Secretary-Executive Director.
