Analysis

Currently, the zoning code treats "broadcasting or recording studio" as a single land use.  This ordinance creates separate definitions and district-by-district use classifications for broadcasting studios and recording studios.  

The ordinance further provides that recording studios shall be classified as a limited use in all zoning districts where broadcasting studios are currently classified as a permitted or limited use.  The limited use standard is that a recording studio shall not be operated between the hours of 10 p.m. and 7 a.m.  If this standard is not met, the studio shall be classified as a prohibited use.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1.  Section 295-201-71 of the code is amended to read:

295-201.  Definitions.

71.  BROADCASTING OR RECORDING STUDIO means an establishment containing one or more broadcasting studios for over-the-air, cable or satellite delivery of radio or television programs [[, or studios for the audio or video recording or filming of musical performances, radio or television programs or motion pictures]] .  This term does not include a transmission tower.

Part 2.  Section 295-201-478 of the code is created to read:

478.  RECORDING STUDIO means an establishment containing one or more studios for the audio or video recording or filming of musical performances, radio or television programs or motion pictures.

Part 3.  Section 295-203-5-o of the code is created to read:

295-203.  Use Definitions.

5.  COMMERCIAL AND OFFICE USES.

o.  "Recording studio" means an establishment containing one or more studios for the audio or video recording or filming of musical performances, radio or television programs or motion pictures.

Part 4.  Section 295-203-15-a of the code is amended to read:

15.  UTILITY AND PUBLIC SERVICE USES.

a.  "Broadcasting or recording studio" means an establishment containing one or more broadcasting studios for over-the-air, cable or satellite delivery of radio or television programs [[, or studios for the audio or video recording or filming of musical performances, radio or television programs or motion pictures]] .  This term does not include a transmission tower.

Part 5.  Table 295-403-2-a of the code is amended to read:
