Analysis

This resolution directs the Commissioner of Public Works to execute a document titled “Grant Agreement Under the Fiscal Year 2022 Safe Streets and Roads for All Grant Program” and associated documents required for the agreement with the United States Department of Transportation Federal Highway Administration for the programming, design, and construction of Pedestrian Accessibility and Safety Improvements at up to 26 intersections City Wide on West Capitol Drive, West Atkinson Avenue, South Cesar Chavez Drive, West Greenfield Avenue and West Forest Home Avenue.  The Agreement provides for 80 percent Federal aid and 20 percent local cost sharing for preliminary engineering.  The total estimated cost of this project is $5,500,000 with a City share of $1,100,000 and a grantor share of $4,400,000.  This resolution also directs the City Comptroller to transfer funds for preliminary engineering at an estimated cost of $675,000 with an estimated City share of $135,000 and a grantor share of $540,000.  Construction funds for this project will be included in future resolutions.

Body

Whereas, A project agreement has been requested and received from the United States Department of Transportation (USDOT) to be executed by the City of Milwaukee for the programming, design, and construction of Pedestrian Accessibility and Safety Improvements at up to 26 intersections City Wide on West Capitol Drive, West Atkinson Avenue, South Cesar Chavez Drive, West Greenfield Avenue and West Forest Home Avenue with Federal aid under the Fiscal Year 2022 Safe Streets and Roads for All Grant Program; and

 

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any cost incurred by the USDOT should the City decide to withdraw from the project; and

 

Whereas, Construction funds for the project will be included in a separate resolution; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to execute the agreement and associated documents for the programming, design, and construction of the aforementioned project with Federal aid, copies of which are attached to this resolution, and are incorporated into this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized to undertake or engage a consultant to undertake preliminary engineering services for the improvement of the aforementioned project; and, be it

 

Further Resolved, That minor changes to the grant agreement which do not change its intent are hereby approved; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design engineering and real estate acquisition for the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
