The applicant was present along with Atty. Brian Randall. Individuals also present: Ald. Dimitrijevic said that it is a brand new liquor request and that she is very pleased with the mayor renovation that has taken place but, that she will object to this application due saturation in the area and per the constituents request. Atty. Randall said that it is a matter of convenience and customer service and that people ask for liquor when they are shopping. He pointed out that the concentration map does not have many blue and red dots which suggest that there is no concentration in the area. He added that the staff will be trained on how to ID people, the liability and that sales point transactions will be at the front of the store. Atty. Randall also mentioned that the CPTED report was all positive. Ald. Spiker asked Atty. Farris regarding the concentration map, what the committee is allowed to look at besides the half-mile radius. Ald. Coggs asked if there is a reason to sell the full liquor instead of beer and wine like he mentioned previously. Atty. Randall said that they want to sell hard liquor as well but that in order to sell wine, they need to apply for the full license. Ald. Spiker asked Mr. Cooney if they can have a restriction on the license to sell wine only. Mr. Cooney said that they can. Atty. Randall requested to hold the application to continue the conversation with Ald. Dimitrijevic. Ald. Spiker moved denial based on concentration and aldermanic testimony. (Prevailed 3-0-1) Ald. The applicant was present along with Atty. Michael Maistelman and said that former Ald. Hamilton supported this application and that BOZA has approved this application as well. Individuals also present: Ald. Spiker asked if we have any documentation from BOZA to support what Atty. Maistelman just said. Mr. Cooney said that he is unable to pull the record but, that former Ald. Hamilton was in support of this application with the hours that were listed on the notice. Ald. Borkowski said that there are six letters in opposition. Atty. Maistelman said that he is aware and they did not have time to turn in the letters in support. Ald. Spiker asked if those objection letters could be taken into consideration. Atty. Farris said that only if they are present. Ald. Borkowski said that he is concerned because people is taking the time to write a letter that it will not be considered if they are not present. Ald. Coggs said that this a quasi-judicial committee and that those letters are to let us know that there is a problem with the business, but that people must be present for cross-examination. Individuals in opposition: Ashi Palmer – 5628 N 38th St – said that it would cause more problems, crime and traffic in her neighborhood, which are the same issues happening on the gas station on 60th St. Ranetta Palmer – 5628 N 36th St - said that they were not aware of this type of business until it was built and, that the neighbors had no input on it. She said that these business owners do not respect the neighborhood and neighbors at all, and that there are four convenience stores around. She said that she is concerned about all the problems that a gas station brings, besides the traffic and that they do not have speed humps. Atty. Maistelman asked Ms. Palmer if she attended the BOZA hearing. Ms. Palmer said that she did. Cassandra Coffer – 5643 N 36th St – said that she is concerned and asked what it is going to be different from the other gas stations like selling cigarettes to minors, loitering, etc. Kathy Boyd – 5644 N 36th St – said that these gas stations bring a lot of trouble to the neighborhood and, that she does not want to deal with those issues neither see her property value down. She added that BOZA did not send notices. Spiker asked the applicant what are they going to do about the trash concerns from the neighbors who are objecting. The applicant said that he has invested close to $2M and, that his family owns other gas stations in the city, and that they will have at least four staff people. Atty. The applicant was present along with Atty. Samantha Brown. Individuals in opposition: William Jones - 3629 N 8th St – said that the garbage bin has been moved to the front of his property and that he has have issues with raccoons and rats ever since. He said that his fence has been ply wooded because he has found people having sex, defecating and that he has to clean up everything. He added that the garbage also blows into his property. Mr. Jones said that this business do not care about the neighborhood and that they do not have a bathroom for their customers so the customers go right on the side, where his house is, and where they supposed to have cameras to do their needs. He also mentioned that people smokes crack right there, that there are cars with loud music and he showed some pictures. Ald. Spiker asked Officer Benitez why there is no police report when the witness has called the police over the years. Officer Benitez said that if the officer on the scene does not write a license premises report, the LIU won’t have a license premises report. He also said that the previous license premises reports are carried over only for alcohol applications. Ald. Spiker asked Atty. Farris if the previous premises report can be considered. Atty. Farris said that he thinks that the ordinance does not distinguish between alcohol or non-alcohol. Ald. Spiker said that he is not getting adequate guidance from the city’s attorney office when he is trying to do his job. Ald. Borkowski asked the witness if other neighbors are treated as wrongly as he is. Mr. Jones said that probably but that his neighbors are not here. Ald. Borkowski said that he has significant issues with this business and asked the witness to encourage his neighbors to come. Atty. Brown had the opportunity to make a cross-examination. Ald. Perez moved to make the pictures part of the record presented by Mr. Jones per Atty. Farris recommendation. Michael Rice – 830 W Atkinson Av - BBNA, LLC – said that he owns the business next door and he showed a live video describing the current situation at the gas station and talked about other issues like cars speeding inside the premises, loud music, loitering, garbage, etc. Atty. Brown had no questions for this witness. Mr. Ernest Velasco – said that he lives a couple of houses down from the gas station and that there is always people loitering outside, drinking alcohol, using drugs and urinating. He said that he is afraid of the people hanging out of the gas station. Atty. Brown had no questions for this witness. Ald. Coggs said that this is a new application and, that there is an existing gas station so the problem still there. She said that she wants to meet with neighbors, MPD and the owner in order to come with some solutions. Ald. Perez moved to hold the application to the call of the chair. There were no objections. The applicant was present and said that the Jazz Thursday Nights got popular and that he could not stop people from coming and that he applied for special permits to do it . He said that he usually follows up with neighbors and, that he always compromises with them. He added that the major complaint are the motorcycles but that no violence has been involved with his business. He said that the reason for being here today is because he wants to have events on May, Jun and July on the parking lot. Individuals also present: Ald. Coggs said that she knows that he is in contact with the two neighbors who showed up at the last hearing. Ald. Spiker asked the applicant to contain these large crowds without using the police department resources. The applicant said that he has increased the number of security guards and that he is monitoring the occupancy to 200 inside and 100 outside. Ald. Coggs said that this business is an institution in the city and that when events get bigger, there are more complaints. She also said that the difference with Jazz in the Park is that it takes place in the park while this business is in the neighborhood; so the noise, garbage, large crowds and traffic are more noticeable. She also mentioned that she received two major complaints: one is the garbage that she knows it has been addressed per the applicant’s testimony and neighbors. She said that the other one is the frequency of the events which it has been handled as well. Ald. Coggs said that neighbors don’t have an issue with the applicant using the parking lot but that they are concerned about the size of the events. She recommended the applicant to contact the neighborhood association to inform how the summer plan is lining up and move from there in order to anticipate. Ald. Perez moved approval.
