Bauman asks the applicants about the lease agreement for the bar because he was contacted by the property owner about other possible tenants besides the applicants. Ald. Bauman says that the letter of intent does not qualify as an interest in the property. Atty. Old World Third St. (expires 7/25/09) Special Letter Applicant at the table, 3045 S. Beverly Dr., New Berlin. Tate Winckler, 1094 W. Deerwood La, Franklin, manager of the establishment. Mr. Winckler says that if a clearly intoxicated person tries to enter the bar, they are stopped at the door. Ald. Bauman says that the bar is not open during the day and it does not serve food. He says that the bar is not a contributor to the resurgence of Old World Third Street. Objector present: Theodore Lipscomb, 5531 N. Shasta Dr., Glendale, Milwaukee County Supervisor. He says that several members of a group he was hosting was showered with beer from the upper patio of the bar after disembarking an Edelweiss Cruise. Mr. Lipscomb says that no one from the bar admitted seeing anyone from the business pour beer on the guests. He also says that an inebriated patron from the bar tried to get involved in the situation and was not controlled in any way by the employees or management of the bar. Mr. Lipscomb said that Mr. Winckler denied that his business was involved in the incident. Mr. Winckler says that he was not a witness to any incident and was told that no one from the bar was involved in the incident. Ald. Bauman says that there are complaints from residents regarding noise from the outdoor patio late at night. He says that the issue is primarily with music after 10:00 p.m. outside. Atty. Whitcomb says that usually music is turned off by 10:00 p.m. unless a special event or party is taking place on the patio. Neighborhood objectors present: Andrew D. Narrai, 108 W. Wells St., Unit 4A, lives in a unit overlooking the outdoor patio. He says that his main concern is the proximity of the patio to units and the loud music that comes from it. Mr. Narrai says that he would like no live music on the patio and no loud music after 10:00 p.m. He also says that music is played after 10:00 p.m. on most nights, not just for special events and parties. Wells St., she says that she has spent many resources at the location and has been supportive of the business. She says that since the format of the location has been changed, the type of music and the noise level on the patio has been disruptive. Nancy Hernandez, 108 W. Wellst St., Unit 4A, is disturbed by the noise and loud music from the patio. Supporters: Stacey Callies, 2565 N. Cramer St., is the executive director of the Westown Association. She says that the business has been an asset to the neighborhood and says that there has been a precedent of having this kind of mixed use business on the riverwalk. Ald. Coggs asks if Ms. Callies is testifying as an individual or as a representative of the association. She says that the official association opinion is support of the business. J. Michael Bartels, 826 N. Plankinton Ave., owner of the commercial portion of the building. He is in support of the license. Joan Bartels Farrell, 11927 N. Bridgewater Dr., Mequon. She is president of the Westown Association, partial owner of the building, and daughter of J. Michael Bartels. She is in support of the license. Eric Butlein, 9303 N. Valley Hill Rd., Milwaukee, is a patron of the restaurant and is in support of the license. He believes that activities such as entertainment on the outdoor patio is crucial to the survival of the business. Mark Vila, 108 W. Wells St., condo association president who supports the business and hopes that the issues with noise on the patio can be resolved. Atty. Whitcomb says that the applicant is willing to amend the plan of operation to Motion by Ald. Coggs to accept the amendment to the plan of operation to restrict the outdoor music to 10:00 p.m. on the patio. Prevailed 4-0. (Ald. Zielinski excused) Grant by Ald. He also says that he has witnessed criminal activity at the location and says that it has become a hangout. Keith Stanley, Main Street Manager for the SoHi District, 624 N. 24th St., says that he has personally witnessed loitering at the location as late as last week. Meeting recessed at 12:41 p.m. Meeting resumed at 12:45 p.m. Ald. Bauman objects to the continuation of the hearing without a court reporter. Ald. Bohl acknowledges the objection but the hearing continues. Supporters: Robert Scott, 2738 W. Clybourn St., says that he does not see loitering outside of the business and is in support of the license. Linda Sanders, 508 W. 28th St., says that there are residents that buy their alcohol at the store and then hang out directly behind the store on a different property. Mr. Atta says that the area where the people who drink hang out is actually about 20 feet from the back of the store. Jim Gleason, 508 N. 28th St., is a patron of the establishment and says that he has never seen any criminal activity or loitering at the location. He is in support of the license. Mr. Gleason says that he has seen the owner ask any loiterers to leave. Rommie Harland, 446 N. 28th St., patronizes the store at least twice a day and never sees any criminal activity at the location. Mary Harland, 446 N. 28th St., is a patron of the store and is in support of Atty. Ledesma says that licensee cleans up in the neighborhood and the business is trying to prevent the nuisances, such as loitering, that concerns the neighbors. Ald. Bauman supports the grocery store aspect of this establishment, but not the liquor license. Since only 12% of the gross sales are due to liquor sales, he feels the grocery store can exist without the liquor sales. He is also concerned that the licensee is solely a front and not actively involved in the business. He urges non-renewal. Grant, with a 10-day suspension based on the police report (item #3 solely) and neigborhood testimony, by Ald. Witkowski. Prevailed. 4-1 (Ald. Coggs voting "no")

Vincent Bobot for the licensee Ald. Bauman at the table - he would not object to this application if it's only a Class "B' Tavern license. The applicant amends his application to remove the Tavern Amusement (Cabaret/Nite Club) portion of the application. Accept withdrawal, by Ald. Zielilnski.
