Minutes note: Kate Borders, Director of Easttown Association, at the table. Ms. Borders says that each night of Jazz in the Park is currently viewed as a separate event needing a temporary extension. This ordinance would eliminate the requirement of Easttown Association to file a temporary extension for each night. Ald. Coggs asks why the city should eliminate a source of funds when it is having difficulty with the budget. She says that the seventy-five dollar fee is nominal and maintaining the current requirement would be a way of providing more revenue for the city. Ms. Borders says that Jazz in the Park is not a profitable event, but it does contributes money to the city in other ways. She says that if the event continues to not make a profit or break even, it will probably not continue. Motion by Zielinski to place on file. Prevailed 4-1. (Ald. Kovac voting “no”)

Special Letter Applicant at the table, 3418 N. Bremen St. Ald. Murphy also at the table. Ald. Murphy says that he has an objector to the license wishes to withdraw her objection, and had not heard any previous complaints in the previous years of operation. Lisa Falsetti, 3971 N. 70th St., says that she has had numerous problems with the location in the summertime, including loud music. She also says that she calls the police to report loud screaming during the week, although things have gotten better recently. Ms. Falsetti says that she is concerned that things have improved because the applicants know they are up for renewal. Applicant says that he has put up two security cameras for the parking lot to ensure that people leave the lot once they leave the establishment. He did release one security guard who was involved with those individuals who were causing problems. He has one security guard intermittently and is interviewing a second individual. Ald. Murphy has contacted the owner about improving the situation, but says the owner has to take the complaints from Ms. Falsetti seriously and correct the problems. Grant, with a warning letter, by Ald. Objectors: George Wagner, 2719 N. 53rd St., has testified opposed to this establishment many times; the licensee has no garbage dumpster behind his premises. Coggs excused)(Exhibit 1) Antoinette Wagner, 2719 N. 53rd St., individual that actually took the photo that was accepted as Exhibit 1. She is concerned about the loud music and says the backyard of the establishment was cleared of weeds and tall grasses just prior to the picture being taken as the licensee's renewal is pending. Nicholas Bruecklin, lives in 50th Street about 3 blocks from this establishment. He says he has noticed illegal parking, loitering and litter. Patrice Bond, 7920 N. 100th St., represents the child care center across the street. Their staff has to clean up the cans, cups and other litter from the establishment. The nights his establishment are open, Ms. Bond says his customers congregate and sit on the steps of the child care facility and also urinate on their steps and defecate in their backyard. Jacqueline Shellaugh, owner of business at 2700 N. 54th St. She says that she has to pick up litter, including condoms, from her property. She also says that whoever takes out the rubbish from his business puts it in her dumpsters. Ms. Shellaugh also says that a security camera mounted on her building was ripped out by an unknown person. Lamont Gary, 2576 N. 50th St., was a bouncer at the establishment during an incident on May 3rd at the club. He says that he received fifty stitches in his face from an assault by patrons and says that he has not received any support from the licensee. Mr. Gary also says that the licensee was present during the assault but did nothing to stop it. Mr. Gary also says that the employees do not allow patrons to leave with bottles of alcohol. If bottles are leaving the bar, he says that patrons must be sneaking them out. Mr. Gary says that no one from the club called the police the night of the assault. He also says that the owner paid some of his doctor’s fees. Officer Shelley Lubus, 951 N. James Lovell St., community liaison officer for District 7. She testified about a 911 call that was placed to the police. She says that no 911 call was made from the bar on the night of the assault incident, but from a cell phone. Mr. George says that he was called to the bar by his sister the night of the assault incident. He says that he cut the music and lights off in the bar at 12:50 a.m. and told the doorman to turn away anymore patrons. Mr. George says that he goes around the property at closing time and picks up garbage. He says that he was outside at the time of the incident and did not witness it, but he says that he called 911 earlier because the crowd at the bar was becoming rowdy. He also denies that he was behind the bar during the assault as Mr. Gary says. Atty. Bobbot says that Mr. George is a responsible licensee and should be able to remain in business. Atty. Pederson says that the Chief of Police believes that the establishment poses a risk to the health, safety and welfare of the neighborhood. Ald. Murphy says that the bar is the most problematic in his district. He says that he does not believe that Mr. George is a responsible business owner or that Mr. George made a 911 call the evening of the assault incident. He points out that the license for the bar has been suspended twice in the past, and he requests that the committee deny or suspend the license. Ald. Kovac moves to deny based on the police report and neighborhood objections. Prevailed 3-1-1 (Ald. Coggs voting “no” and Ald. Bohl abstaining) Ald. Coggs says that the incident that occurred on May 3rd has not been adjudicated yet, and she cannot support the motion based on that.
