Minutes note: Atty. Andrew Arena at the table as counsel. Applicant at the table. Asst. City Attorney Adam Stephens at the table. He says that the part of the police department complaint dealing with the Cigarette and Tobacco license can be disregarded. Ald. Zielinski moves to amend the motion as a revocation for the Class "A" Malt and Food Dealer licenses only. Prevailed 5-0. Mr. Stephens summarizes the police complaint. He also requests that Sgt. Ulickey read the complete police report into the record. Sgt. Ulickey does so. Mr. Arena objects to the items in the PA33 as hearsay. Mr. Schrimpf says that it is a record kept in the course of action by the police department and as such is a narrative, not a summary. The objection is noted. Sgt. Ulickey reads from the PA33, and Mr. Arena objects to the reading of the police report again as double hearsay. The objection is noted, but the committee decides to proceed despite the objection. Ald. Kovac moves to make the PA33 police report for July 28th, 2008 part of the official record. Prevailed 5-0. Ald. Bohl asks if any illegal weapons charges were brought against the licensee. Atty. Stephens says he doesn't believe so and Mr. Arena says no. David Salazar, Detective with Homicide Division of District 4 of the Milwaukee Police Department, at the table. He says that the licensee admitted, in a conversation with the detective during the murder investigation, to the drug use that is alleged in the complaint. Ald. Bohl asks why criminal charges were not brought against the licensee. Det. Salazar says that arrests are made upon the discretion of each officer and that homicide investigations involve circumstances that do not always lead to arrests in the course of the investigations. Det. Salazar says each case is different. Mr. Arena asks if Mr. Castiglione was Mirandized during the conversation in which he admitted to drug use, and Det. Salazar says he was not due to Mr. Castiglione not being in custody. Mr. Arena asks if any drug transactions occurred on a surveillance video taken in the store, and Det. Salazar says no. Det. Salazar says that Mr. Castiglione told him that the drug deal between the decedent and himself occurred in the parking lot where there was no video camera. Det. Salazar says the firearms found in the store were not found to be altered illegally and they were not evidence of a crime, so they were not seized. Mr. Castiglione is not a felon, so it was not illegal for him to have the firearms. The stun gun was illegal to possess, so it was confiscated. Mr. Arena points out that Mr. Castiglione has not been charged or convicted with any crime. He also says that the licensee has never been in front of the committee with regards to his malt license and that the store is a family business. He also says that the applicant has narcolepsy. Mr. Arena says that Mr. Castiglione denies doing drugs and that any illegal paraphernalia found at the store was that of an employee. Mr. Arena says that Mr. Castiglione has firearms at the store because he was robbed at the store in the past and because he did not want to keep them at home. He also says that the licensee did know the murder victim as a customer, but that the victim was a friend of the woman named in the police report. Mr. Arena say there is a camera focused on the parking lot a the business, but it does not record. He also says that the applicant only told the police the story that he did because he thought it was what he wanted them to hear. Jack A. Castiglione, licensee, testifying. Ald. Zielinski asks Mr. Castiglione why he lied to the police. Mr. Castiglione says that he told the officer the story because he thought it was what the Detective wanted to hear and because he felt pressured. He didn't think anything would come of it. Ald. Zielinski asked about the drug paraphernalia, and Mr. Castiglione says that he doesn't know how it arrived in his store. Detective Salazar back at the table. He testifies about a tape taken at the business location. Mr. Schrimpf asks about two interviews with the police and Mr. Castiglione. Mr. Castiglione says that the police officer who interviewed him the first time in his store had facts and times wrong in the report of the interview. Mr. Schrimpf ask Mr. Castiglione when the interview in his store occurred and Mr. Castiglione replied that it was in the afternoon. Ald. Zielinski asks Mr. Castiglione why he maintained the same story between with both officers. Mr. Castiglione says that he did not think it was important. In response to a question by Ald. Zielinski, Det. Salazar says he believes that Mr. Salazar was telling him the truth during the interview. No neighborhood objectors present when called. Larry Castiglione, N79 W15059 Menomonee Manor Drive, Menomonee Falls, father of the applicant, owner of the building and member of the LLC. He says that business has been in the family since 1939. He says he is upset that a surveillance tape from the business was not brought to committee by the police. He also says that there has been no trouble at the store and he believes that the alderman of the district should have made himself known to his son, the licensee. prior to the revocation being filed. Ald. Bohl requests that the City Clerk's office post larger signs outside the door of the Committee room telling applicants to turn off all cell phones. Mr. Arena asks why Mr. Castiglione told a story about drug use to the police. Mr. Castiglione says that he felt was under pressure to tell the police a story since he felt that the truth was not being believed. Mr. Arena says that there is no record of past drug activity at the store. He also says that if any action is taken, a suspension would be more appropriate. Atty. Stephens requests that the committee recommend revocation of the license. Revocation based on the police report as well as corroborating testimony from the police department. Prevailed 4-1. (Ald. Minutes note: Applicant at the table, 5051 N. 19th Place, as is Asst. City Attorney Adam Stephens. Atty. Jeff Purnell, counsel for the applicant, at the table with the applicant. Mr. Purnell asks that the matter be held so he can have more time to develop a case, because Ald. Coggs is not present, and because Ms. Peavey did not receive adequate notice of the hearing. Mr. Schrimpf confirms that there was adequate notice by law to the licensee. Atty. Adam Stephens summarizes the complaint from the police department. Atty. Stephens says that the property has been declared a nuisance and that she no longer is acting as the person in charge of the business despite being the agent. Capt. Anthony Smith of District 5 of the Milwaukee Police Department at the table. Neighborhood objectors present: Sarah Noble, 2916 N. Richards St., moved at the end of September from across the street from the bar. She says there are parking problems and people standing in the streets not moving in the early hours of the morning. She found a person sleeping on her front porch and had to call the police to have him removed. Ms. Noble says that there is no control over the crowd at the house. She related an incident in which she was threatened with shooting by a patron of the bar that was loitering in front of her home. Mr. Purnell asks if Ms. Noble ever saw guns being fired and Ms. Noble said no. Ms. Noble says that she had a clear view of the bar from her home and could see problem patrons coming from the bar. Kyla Fernandez, 2737 N. Buffum St., seven homes south of the bar. Moved to the neighborhood in June of last year. Says that she had to call the police about the bar a few times in the months between moving to the area and winter, but that in winter the problems slowed down. Since winter ended, there has been loud noise, loud voices, and fighting in front of her house. She has also heard shots fired and called the police. Ald. Bohl asks if Ms. Fernandez can identify the problem patrons as having come from the bar. Ms. Fernandez says yes. Frank Dettloff, 2526 N. Dousman St., owns 2764 N. Buffum St., where Sarah Noble was living. Had an agreement with Sarah Noble for her to buy the home. Says he noticed bottles and beer cans on the lawn of the home when he would visit the property. Ald. Coggs back at the table at 4:45 p.m. Ald. Coggs asks Ms. Peavey if she sells beer in cans in the tavern. Ms. Peavey says no. Jackie Reid-Dettloff, also owner of 2764 N. Buffum St. She says that there have been 26 incident reports at the tavern since the license was renewed. Gordon Kaufert, 2765 N. Buffum St., two doors from the bar. He said that he called the police whenever he saw problems at including loud music, large unruly crowds and shots fired. After one incident of shots fired, shell casings were found on his porch. He says he feels patrons have tried to intimidate him because he calls police so much. Mr. Kaufert says that the bar doesn't get busy until after midnight, even though it closes at 2:00 p.m. He says he never had a problem with the tavern until Mr. Green took over operating the establishment. Ald. Zielinski moves to make notes taken by Mr. Kaufert indicating dates and times of calls he made to the police part of the record. Prevailed 4-0. (Ald. She says that the same things happen in the day as they do during the day because it is a ghetto environment. She says that no police are called when things happen during the day. She says there are no new problems since Mr. Green took over and that cruising is going to happen regardless. She says that Club Timbuktu has caused more problems that the Groovin' Inn has and sees people parking and walking to Timbuktu. Mr. Stephens asks Ms. Luckett if is a patron of the bar and she says yes. He also asks her if she knows Mr. Green, and she says that he is an acquaintance and met him through the bar. Doris Mosley, 2803 N. Buffum St., says that she has not seen the problems alleged at the establishment now that the age limit has been raised to 25 at the bar on the weekends. Mr. Stephens asks Ms. Mosley if she knows Mr. Green and she says that she only has contact with him when Mr. Green comes around to talk to neighbors. Ms. Peavey says that Mr. Green is a bartender who works for her and does what she tell him to do. Ald. Kovac makes the two letters from Miguel Green to neighbors part of the record. Prevailed 4-0.
