080610 0 MotionMotion relating to the recommendations of the Licenses Committee relative to various licenses.

Minutes note: 10 CRAWFORD, Daniel, Class “B” Tavern renewal application for “Ark Inn” at 235 N. 36th Street. (expires 11-28-08) Special Letter Applicant at the table. He objects to Items 1-4 being on the police report since they were considered previously by the Licenses Committee. Ald. Michael Murphy at the table as well. The applicant says that the fight detailed on the police report started outside of the tavern. He says that he has been closing at 10:00p.m. or 11:00p.m. because of problems and has been losing money because of it. He says he himself has called the police and the alderman about traffic, drug activity and other problems in the neighborhood and he says he has put cameras and lights in his property. Neighborhood supporters present: Patrick Fengier, 3745 W. Michigan St., recently moved from 237 N. 37th St. He says that part of the problem is lack of police patrols in the area. He says the neighborhood has changed and that there are a lot of property renters now as opposed to homeowners. Mr. Fengier says that the area in the valley is not being well-represented and he says the bar takes the blame for problems in the neighborhood. Kathleen Thornton, 206 N. 36th St., has lived in the area since 1982. She says a lot of the problems are caused by the neighbors, not the bar. Ald. Zielinski says that there are bars located in high crime areas that don't have problems and asks Ms. Thornton to explain this. She feels that if the bar closes down she will lose a lot of the security of knowing the bar is open and has lights and security cameras. Joann Fitzlaff, 3607 W. Mt. Vernon Ave., doesn't think that the bar is the problem, but the people within a two-block radius of the establishment are the source of the issues. Cliff Pasholk, 213 N. 77th St., not a neighbor, but frequents the establishment. He says the applicant runs a clean establishment and keeps everything in order. Ald. Murphy says about two years ago the applicant stopped running a good bar. He mentions that the applicant's license was previously suspended for 30 days. Ald. Murphy says that there are two other bars in the immediate area that never have the same kinds of complaints. He believes that the bar has become an attractive nuisance. Ald. Murphy says that the applicant has changed the kind of music played in the establishment as recommended previously and he admits that the applicant has called the alderman's office and the police regarding problems. Mr. Crawford says if there are problem patrons he kicks them out. He says he is willing to close at midnight in order to keep his bar. Ald. Zielinski says that there has been no improvement since the 30-day suspension last year. Ald. Zielinski moves to deny based on matters contained in the police report. Failed 1-3. (Alds. Hamilton, Bohl and Kovac voting "no") Ald. Hamilton moves to amend the hours of operation to reflect a 12:00a.m. closing time seven days a week. Prevailed 4-0. (Ald. Coggs excused) Ald. Hamilton moves to grant with a 60-day suspension based on the police report as amended. Prevailed 4-0. (Ald. Coggs excused)

Minutes note: 15 MC KENZIE, Ricardo D., Class “B” Tavern and Tavern Amusement (Cabaret/Nite Club) applications with an age distinction of 25 years of age and older for “Tropical Vibes Nite Club” at 2035 W. Fond du Lac Avenue. Special Letter Applicant is at the table. District 15 Staff Assistant Alex Runner also at the table. The application is new because of the change of legal entity (partnership to individual), so there is a police report on file from the previous license. Sgt. Ulickey proposes starting the reading of the police report at the year 2007. An application submitted by managers working at the previous establishment for the location in question was heard at a previous Licenses Committee meeting. The current applicant was also the owner of the establishment's previous incarnation. Ald. Kovac moves to make the entire police report part of the record. Prevailed 4-0. (Ald. Coggs excused) Ald. Zielinski moves to make an updated plan of operation from the applicant part of the record. Prevailed 4-0. (Ald. Coggs excused) Mr. McKenzie says that problems with the previous incarnation of the establishment, Leoric Sports Bar, was a result of bad management while he was out of the country. Mr. McKenzie says he is changing the name and type of music. Mr. Runner says that the format of the establishment has already been changed for the last six months and that things are better since changes were made. The previous establishment, Leoric Sports Bar, only had a Class "B" Tavern license, not Tavern Amusement. No neighborhood objectors/supporters present when called. Mr. Runner says that Pres. Hines trusts the committee's judgment regarding the recommendation. Ald. Zielinski moves to deny based on the police report. Prevailed 4-0. (Ald. Coggs excused)
