080607 01.MotionSubstitute motion granting the food dealer license of Syed Rizvi for the premises at 405 N. 27th Street, doing business as JDA Petroleum, Inc.

Minutes note: Applicant and Ald. Bauman at the table. Ald. Coggs moves to make affidavit of service part of the record. Prevailed 4-0. (Ald. Zielinski excused.) Ald. Hamilton moves to make the complete police report part of the record. Prevailed 4-0. (Ald. Zielinski excused.) Ald. Zielinski at the table at 8:15 a.m. Mr. Rizvi says that the paraphernalia charge occurred while he was just a worker at another location on Green Bay Rd. Ald. Bauman says that the food license was issued in error due to a lack of a disposition on the second charge of the police report. Rebecca Grill says that the applicant has a cigarette license at the location where he was cited for Possession of Drug Paraphernalia, and he is listed as the agent and only officer at the location. Regarding the first charge on the police report, Mr. Rizvi said it was the result of an altercation with a customer. The customer took money that did not belong to her and the applicant ran outside and confronted the customer at her car. The police came later and gave him a disorderly conduct ticket. Assistant City Attorney Tom Miller asks what the item was that resulted in the drug paraphernalia charge. Mr. Rizvi said that it was the "rose in plastic tube" product. He says he was unaware that that product was considered by police as drug paraphernalia when sold in convenience stores and gas stations and illegal. Ald. Bauman said that the Health Department sent the applicant a letter saying that his food license was void. He also says that he would most likely object to the license if the applicant was not the nephew of Jay Walia, a well-known operator of gas stations who is also the owner of the property. Ald. Zielinski moves to grant despite matters contained in the police report. Prevailed 5-0.

She says the neighborhood wants something positive in the area, and she doesn't believe a tavern is positive. Nicholas Brecklin, 2728 N. 50th st., thinks one bar is enough for the neighborhood. Mr. Heinemeier says that closing at 10:00 p.m. has Bernadette Davel, 3271 N. 46th St., from St. Catherine Parish on 51st and Center. The parish has been organizing and has been trying to keep the neighborhood free from crime problems. She feels insulted by someone who doesn't live in the community bringing in a business that will not improve the community. She is appearing on behalf of the parish and the pastor was unable to attend. Mr. Heinemeier says he moved out of the neighborhood due to a home invasion after which his family didn't fee safe. Neighborhood supporters: Lara Williams, 509A S. 70th St., previously lived in the area six blocks away from the establishment. She never felt threatened at the establishment and is in support of the applicant. Cavonna Assigbley, 3810 S. 84th st. B-1, previously lived at 39th and Sheridan. She used to visit Terry Lee's and supports the re-opening. Ald. Murphy asks Ms. Assigbley if the she knows a woman was hit in the head with a pool cue at the location. She says that she was unaware of it but believes that when it did happen the owners probably addressed the problem. Regina Henderson, 5520 W. Center, Apt. W, lives in the area. She lives above a church in the area and doesn't see a problem with the establishment if the location closes at 10:00 p.m. Is a tenant of Mr. Heinemeier. Justine Williams, 2215 A N. 40th St., supports the bar being re-opened. Phillip Smith, 5164 N. Sherman Blvd., supports the bar and used to patronized the location with no problems. He says sometimes what goes on outside cannot be controlled. Therese Halaska-Hunn, Germantown, is in support of the bar. Used to run the karaoke show and never had any problems. Linda Farrington, 5514 W. Center #2, is in support of the bar and would like a place to walk to after work to get a drink. Is a tenant of Mr. Heinemeier. Quenna Brown, 5559 N. 38th St., has been to the establishment previously and never had problems. She thinks the applicant has complete control of the establishment. Kevin Culver, 2525 S. Howell Ave. #2, says he thinks Mr. Heinemeier has made improvements to his establishment on Silver Spring Dr. and thinks that the same will be done at the Center St. location. Mr. Heinemeier says he is just looking for a second chance. He says the problems he had started in 2003 after no previous problems renewing the license. The applicant started closing the bar at 10:00 p.m. without being asked to do so. Atty. Miller clarifies that the previous denial was based on the police report and non-appearance. Mr. Heinemeier says he addressed the problems that happened after the clientele changed to a different crowd. He also says he listened to neighbors' concerns about safety. Ald. Murphy says he held a neighborhood meeting with 26 neighbors attending, and 20 people were opposed to the establishment opening up. He says that during a month between two violent incidents, there was no change at the establishment and that the applicant has not made any move to improve the neighborhood. Ald. Murphy is willing to work with the applicant to develop a positive business at the location. Ald. Kovac moves to make the Findings of Fact and Conclusions of Law from February 2005 hearing be made part of the record. Prevailed 3-0 (Alds. Coggs and Zielinski excused) Ald. Hamilton notes that if it were not a new application, the application would be considered differently. Ald. Hamilton moves to deny based on the police report and neighborhood testimony. Minutes note: 03 MC COY, Cary M., Agent for “CMM Investments, LLC”, Class “B” Tavern application for “901 Lounge” at 901 E. Wright Street. New Location Special Letter Applicant at the table. Held a neighborhood meeting at 901 E. Wright St. She also went to the Riverwest Association meeting. She proposes changing her hours to close at 11:30 p.m. on weeknights (Sunday through Thursday) and 1:00 a.m. on weekends (Friday and Saturday). Ms. McCoy says that the applicant would primarily be running the location as a restaurant, not a tavern. Neighborhood objectors present: Erik Anderson, 827 E. Wright St., lives 45 feet from the location. He thinks the establishment would take away from the peaceful environment and would detract from the neighborhood. Ald. Kovac moves to make a letter to District 3 constituents dated September 11, 2008 part of the record. Prevailed 5-0. Ald. Kovac moves to make a concentration map centered on 901 E. Wright St. dated September 1, 2008 part of thre record. Prevailed 5-0. Ben Schultz, 2467A N. Bremen St., lives near the location. He thinks the plan to open up a restaurant is rushed since the applicant previously wanted to open up a bar. He wants to know where she expects her clientele to come from. He thinks patrons from outside the neighborhood may contribute to an already existing parking problem. Elizabeth Colvin, 2467A N. Bremen St. says she doesn't want to be disturbed by patrons leaving the restaurant at late hours. She is also concerned about the parking situation. She also is concerned about the applicant's restaurant experience and would like to see someone with more experience running the location. The applicant requests amending the application. Ald. Coggs moves to approve the amended plan of operation to reflect a closing time of 11:30 p.m. on weeknights (Sunday through Thursday) and 1:00 a.m. on weekends (Friday and Saturday). Prevailed 5-0. Ald. Kovac said about two-thirds of the attendants of a neighborhood meeting were in opposition to the application. He also says the Riverwest Neighborhood Association would not support another tavern in the area. Mr. Anderson says that the name "901 Lounge" doesn't bring to mind a restaurant. Ms. McCoy said that she is going to change the name, but she doesn't yet know what name to which the establishment will be changed. Ald. Kovac moves to grant as amended. Prevailed 5-0.

New Location Special Letter Applicant at the table. Ald. Hines, Jr. at the table as is his staff assistant, Alex Runner. Doyle Shephard, 6191 N. Denmark St., the son of the applicant. He says if things go well, the establishment plans to expand into liquor sales. Ald. Hines, Jr. appearing as a resident of the neighborhood, 2361 N. 46th St. Four years ago when the establishment opened there was no desire expressed by the applicant to sell beer. Mr. Hines, Jr. says that a previous location at 45th and North Avenue that sold beer created a number of problems. He also says that there has been an increase in litter, in part from the location, and that does not think a liquor license would be complimentary to the neighborhood. Damian Shephard, 9707 W. Rochelle Ave., son of the applicant. He thinks that the presence of beer at the location will not be detrimental to the neighborhood and he says that the location is kept neat and tidy. Mr. Runner, 2377 N. 48th St., says Ald. Hines, Jr.'s office has heard concerns from neighbors. The area is a Business Improvement District (BID) and there is opposition to any establishment that is not a restaurant having a liquor license. Ald. Zielinski moves to deny based on neighborhood testimony. Prevailed 5-0.
