Robinson, Jr., applicant, represented by counsel, Atty. Michael Maistelman 8129 W. Kensington Dr., Mequon, WI 53097 Individuals also appearing at the table: Nicholas DeSiato, Assistant City Attorney Sherman Morton, Legislative Assistant on behalf of Ald. Joe Davis in the 2nd Aldermanic District In response to questions from Atty. DeSiato, Officer Lisa Saffold of the Milwaukee Police Department appeared and testified in opposition. She did not see a license renewal application posting at the club as required on February 8, 2013. She was involved in a meeting with the licensee on April 3, 2012 to discuss dangerous incidents at the club, which consisted of a shooting, sexual assault, and several armed robberies in 2012. Also discussed were security measures of an age restriction of 30 years and older, use of a wand scanner, patting down of patrons, and use of a scanner to check driver's licenses and IDs. She was involved in a September 11, 2012 meeting with the licensee discussing additional criminal incidents at the club after the first meeting. A nuisance letter was sent to the licensee on August 8, 2012 due to a battery incident on August 7, 2012 and a felony possession of a firearm incident on March 25, 2012. The nuisance designation was not sought after a plan was submitted by the licensee. Based on police REMS reports, there were at least four instances of individuals under 30 years of age who patronized the club. The licensee is believed to have conducted karaoke at the club without the proper license as indicated in a 2013 Facebook posting that Officer Saffold has seen. Ald. Kovac moved to make a 2013 Facebook posting, provided by Atty. DeSiato, as part of the record. There were no objections. In response to questions from Atty. DeSiato, Officer Jessica Lowery of the Milwaukee Police Department appeared and testified in opposition. She responded to the January 20, 2013 shots fired incident and observed two bullet holes in a window at club. Through the club's security footage, she observed that there was a fight between two male patrons that evening inside the club, and security escorted those patrons out of the building. A female patron was later found to have been grazed by a bullet at the top of her head later that night. Officer Lowery further testified of being involved in an undercover investigation at the club on February 6, 2013. Atty. Maistelman objected to Officer Lowery's testimony regarding the undercover investigation on February 6, 2013 due to lack of notice on the matter. Atty. Stephens concurred. The committee sustained Atty. Maistelman's objection. In response to questions from Atty. DeSiato, Officer Michael Smith of the Milwaukee Police Department, appeared and testified in opposition. He was on duty and responded to a battery incident on August 7, 2012. He has seen an electronic sign outside the club advertising "Karaoke Tonight" back in September or October 2012. Atty. Maistelman objected to Officer Smith's testimony of the August 7, 2012 battery incident due to lack of notice on the matter. Atty. Stephens concurred. The committee sustained Atty. Maistelman's objection. Individuals appearing in support: Charles McCurtis, 5464 N. 53rd St., Milwaukee, WI 53218 Doug Gustapo, 6622 W. Eden Pl., Milwaukee, WI 53220 Benny Cooper, 3604 N. 13th St., Milwaukee, WI 53206 Maurice Beckley, 544 E. Ogden St., Milwaukee, WI 53202 Mr. McCurtis testified of being an entertainer who has performed at the club for three years without observing any incidents. At the club, he has observed older clienteles aged 30 and above, soul food service, and blues music. Mr. Gustapo testified that he outsourced security to the club and that the club security uses a handheld ID scanner; however, he has not personally witness the handheld ID scanner being used at the club. Mr. Cooper testified that the club runs a good operation, does not use bottles anymore, and has security that immediately removes patrons who fight. Mr. Beckley testified that his company provides DJ and sound services to the club and that the club runs a good operation. Detective Terrence Bender, Milwaukee Police Department, appeared and testified to questions from Atty. Maistelman. He was involved in the January 20, 2013 shooting investigation at the club. During his investigation, the club staff was cooperative and assisted in the investigation. Security cameras inside the club showed him that a fight occurred inside the club that night. The outside club security camera did not capture the shooting. The initial fight inside the club started with a 21 year old patron. He has personally patronized the club in the afternoon and early evening observing a safe environment, no incidents, old school and R & B music, and food service. Mr. Morton was present with objections to the karaoke addition and no objections to the change in hours. He was neutral concerning the other aspects of the license renewal applications. Atty. Maistelman, on behalf of the licensee, requested to withdraw the karaoke addition. Ald. Coggs moved to accept the withdrawal of the karaoke application. There were no objections. Atty. DeSiato said that a severe suspension is warranted based on the absence of adequate implementation of the club's security plan despite opportunities within the past year, continued criminal incidents at the club despite meeting with police two times in 2012, incidents of patrons under 30 years of age at the club as reflected by the testimonies of Officer Saffold and Detective Bender, an argument or fight between patrons inside the club leading to the shots fired incidents on March 25, 2012 and January 20, 2013. Mr. Robinson testified that his previous security card scanner was lost or stolen, does not remember the names of the ten individuals banned from the bar, can recall two of the banned patrons who were involved in the gun incidents, the handheld scanner does not show a picture of an individual, and the scanner does not contain the information of the banned patrons. He further testified that there was a fight inside the club between patrons on January 20, 2013, the suspect with the gun on March 25, 2012 was apprehended by his security inside the club, and one of his security personnel located the gun used on March 25, 2012 to the police. He is open to work with police and the community. Atty. Maistelman said that the club is responsible for the January 20, 2013 fight incident, police have offered contradictory testimony as reflected by Detective Bender's positive experience of patronizing the bar, and the licensee is being proactive to implement his security plan and improve the club. Layton Blvd., Milwaukee, WI 53215 Mr. Krueger testified in opposition to the Public Entertainment Premises license. He has witnessed the following: loud music from the bar, cigarette butts on the ground in the morning, vomit on and near his business entrance, and urination on the doors and walls by the entrances of his business. He has been personally cleaning up the vomit and urination outside of his business, which is by the bar. He has not personally seen the patrons of the bar engaged in these activities, but he has observed that these issues surfaces only during the times that the tavern is in operation. Pastor Methum testified that his Baptist church next to Lex had to moved its dumpster because beer bottles from Lex were being placed into the church dumpster. Pastor Methum has observed within the past year increased vandalism, urination, vomiting, cigarette butts, noise, and beer cans in the area. The people who were in charged of the tavern had a party atmosphere. The tavern operates on Sundays, which negatively affects the church concerning parking. He has noticed these issues only when the bar is in operation. Mr. Green testified that the front window of his food shop at 3048 S. 13th St. was recently broken window. His security footage showed four individuals come to the front of his shop from the direction of the bar. The individuals fought and his front window was broken as a result. The footage also showed to him Lex's security guards at the scene seconds later. A second incident, which was a shooting, was also recently caught on his security camera. He believes these two events stemmed from the tavern. Ms. Bermudez testified that lack of parking on Sunday mornings and recent graffiti in the area affects her experience at the Baptist church next door to the tavern. She attributes the lack of parking and graffiti to Lex, and she also has observed troubled church members patronize the tavern. Ms. Flores, Mr. Teague, and Mr. Hill testified that they all attend the Baptist church next door and that they agree with the testimonies of the previous speakers. Captain Rowe testified that during her 6 months of being appointed as captain, her district has been forced to deploy officers specifically to area of the bar due to the bar's activities. As a result, police resources have been drained in the district. A nuisance warning letter was issued to the licensee. Ald. Coggs moved to make police documents, letters, and a timeline, provided by Officer Felix, as part of the record. There were no objections. Officer Felix testified that the licensee failed to respond to initial nuisance letters that were sent to Mr. Solovjev. On February 8, 2013, he met with Mr. Solovjev, who had an action plan. Mr. Solovjev explained at the meeting that he hired a bar manager to operate and manage the bar while he did truck driving. Mr. Solovjev also explained to him that the bar manager would pay 1000 dollars rent and keep the profits. Mr. Solovjev testified that he has not actively operated the bar since July 2012 due to working as a truck driver in order to help pay taxes and maintain his ownership to the building. He hired a licensed bar manager since that time to run the bar, pay all bills on the building, make personnel decisions, and purchase products. The bar manager did not give 1000 dollars rent to him. His decision to trust the bar manager was a mistake, and he has since fired the bar manager last week. An option going forward would be to find a tenant. Atty.
