Mr. Detrich testified that he has observed the establishment changing to a bar from a restaurant, patrons parking in the neighborhood, patrons walking through the neighborhood, patrons being loud when leaving the bar, and the bar having an outside sign that upsets his wife due to its showing of women in tight clothing. He added that he objects to the change in hours and change in entertainment, except dancing and karoake.
Ms. Prothero testified to observing the bar being open on Monday nights beyond what it is licensed for and to seeing offensive signs of women inside and outside of the bar. She added that she is in objection to the change in hours, bands, and reality shows.
Mr. Vlies testified that he has observed the establishment changing from being a small food establishment to a bar, heard screaming and swearing from patrons on the patio at 1:30 a.m., seeing patrons leave their cars in the neighborhood for days due to being intoxicated, and observed erratic business hours. He added that he is in objection to any expansion of the licenses and that the licensee is not approachable.
Ms. Beilke testified that she agrees with the testimonies of Mr. Detrich, Ms. Prothero, and Mr. Vlies. She added that she has witnessed issues of the owner yelling, noise violations, motorcycles noise, patrons yelling in the streets, patrons playing their music loudly, litter, broken glass, abandoned vehicles in the parking lot, fights outside, patrons on the patio creating noise, and no beer delivery from trucks.
Mr. Cruz testified to witnessing loud noise, being up late at night due to the bar, and agreeing with the testimonies of Mr. Detrich, Ms. Prothero, Mr. Vlies, and Ms. Beilke.
Ald. Witkowski was present in opposition. He said that the licensee was cited by the State of Wisconsin for not buying alcohol from wholesalers but from retailers instead.

Mr. Beronja testified to witnessing the following: pedestricians and traffic on his street and loud vehicles driving past his house at at 1:15 a.m. in the morning, a man punching another man in front of his house, broken liquor bottles on his driveway, public drinking at 9 p.m. or 10 p.m., traffic jam at 1:30 a.m., and cars going around a blockade on Bruce St. These incidents occur around the time Texture closes its operation and that there is a correlation with Texture's closing. To his knowledge, there are other clubs in he area but no other establishments follows the hours of Texture. These issues worse on Sunday nights. He has been awakened from his sleep due to these disturbances. In addition, two shootings have occurred within the past year outside his house at night with one at 1:30 a.m. and the second on Sunday night. He has been a resident of the area for about 20 years.
Ms. Kaufmann testified that she has been outspoken against Texture for three years and was threatened with civil legal action by Texture's counsel at a neighborhood meeting. At last year's Licenses Committee meeting her house was videotaped by Texture as shown by Texture's video, she went through 40 minutes of cross examination by Texture's counsel, and she was verbally assaulted by Mr. Salvo's father. These occurances are acts of intimidation and bullying, in her view. Texture or its counsel has not reached out to her. During the last licensing year, she has experienced noise and similar disruptions of pervious years. She filed a few email complaints, including one regarding to hearing gun shots on March 12, 2012. Under oath at last year's Licenses Committee hearing, Mr. Salvo testified that he would not renew the licenses after its expiration in July 2012.

Mr. Salvo said that he did not reach out to Ms. Kaufmann and that he had testified under oath at last year's Licenses Committee hearing to not renew the licenses due to being frustrated and tired.
Ald. Perez testified that he, along with constituents that he has been in contact with, were frustrated by the noise and traffic during closing bar time from Texture. He said that he personally witnessed people driving on sidewalks, presence of police, a chaotic scene, and people peppered sprayed in front of his car. He added that Texture's closing process was inconsistent and the most recent Sunday night closing from Texture was bad.
Atty. Stephens gave an update on the legal situation regarding Texture's licenses. The licenses has been in litigation for more than 2 licensing years. The court struck the decision of the Licenses Committee and Common Council last year and judicially ordered issuance of last year's renewal licenses. The City is appealing.
